Board of Supervisors’ Meeting

Minutes of January 5, 2004 - Reorganization Meeting

The meeting was called to order at 9:50 a.m. by Chairman Sellers.  Supervisor Brutscher and Hubbard were present along with Bill Harwood, Building Inspector and Zoning Officer.  Supervisor Brutscher dispensed with the pledge of allegiance.

Announcements:  There were no announcements or reports.

 Reorganization:

Hubbard moved, Sellers seconded to elect Georgia Brutscher as temporary Chair and Karen Eckard as temporary Secretary.  Motion carried.

Brutscher moved, Hubbard seconded to appoint William Sellers as Chair of the Supervisors.  Motion carried. 

 Hubbard moved, Sellers seconded to appoint Georgia Brutscher as Vice Chair of the Supervisors.  Motion carried.

Sellers moved, Brutscher seconded to appoint Karen Eckard as Secretary/Treasurer at an annual salary that was tabled so further discussion could take place until the next Board meeting.  Motion carried.

Hubbard moved, Brutscher seconded that a recommendation be made to the Board of Auditors to obtain a Treasurer’s Bond in the amount of $400,000.  Motion carried.

Hubbard moved, Brutscher seconded that William Harwood be appointed Zoning Officer at an annual salary of $1,200, plus 75% of court fines when attending court hearings and all other fees will be by resolution.  Motion carried.

Sellers moved, Brutscher seconded to appoint Ezekiel Hubbard as Road Supervisor.  Motion carried.

Sellers moved, Brutscher seconded to appoint William Harwood as Building Inspector, Building Site Inspector, and Soil and Erosion Control Inspector at the fees established by Resolution.  Motion carried.

Sellers moved, Hubbard seconded the following appointments to the Planning Commission:

Sellers moved, Hubbard seconded to appoint Robert Woodward as Pocopson Township’s alternate representative to the West Chester Regional Planning Commission, with his or her term to expire on December 31, 2004.  Note:  Another representative member will be appointed at a later Board meeting.

Sellers moved, Hubbard seconded to appoint Georgia Brutscher as Pocopson Township’s representative to the Kennett Area Regional Planning Commission, with her term to expire on December 31, 2004.  Motion carried.

Sellers moved, Hubbard seconded to appoint Bruce Yelton as Pocopson Township’s alternate representative to the Kennett Area Regional Planning Commission with his term to expire on December 31, 2004.  Motion carried.

Brutscher moved, Sellers seconded to appoint Ross Unruh, Esquire, of Unruh, Turner, Burke and Frees, as Solicitor of Pocopson Township at an hourly rate of $175.00 per hour.  Motion carried.

Brutscher moved, Hubbard seconded to appoint Vandemark & Lynch, Inc. as Township Engineer with the rates for principal staff as set forth in the letter of December 22, 2003 from John Fenn.  Motion carried.

Brutscher moved, Sellers seconded to appoint Ezekiel Hubbard as the Emergency Management Coordinator, with his term to expire on December 31, 2004.  Motion carried.

Sellers moved, Hubbard seconded to designate emergency service providers and establish the territories by resolution for response and support to Longwood Fire and Ambulance Companies and Pomarlin Fire Company.  Motion carried.

Sellers volunteered to speak with Randy Mims about becoming the Chairman of the Vacancy Board with his term to expire on December 31, 2004.  The Board agreed to make this appointment at a later date.

Brutscher moved, Sellers seconded to appoint William Harwood as Director of Public Works and reimburse him for his cell phone which is used for township business.  Motion carried.

Brutscher moved, Sellers seconded to establish the pay range for the part-time road crew from minimum wage to $17.00 per hour, at the discretion of the Director of Public Works.  Motion carried.

Brutscher moved, Hubbard seconded to establish holidays for the Township as follows:

Sellers moved, Hubbard seconded to appoint PIRMA as the insurance broker for the township.  Motion carried.

Brutscher moved, Hubbard seconded to appoint Berkheimer Associates as Tax Collector for the Occupational Privilege Tax.  Motion carried.

Brutscher moved, Hubbard seconded to appoint Christopher Sperber as Tax Collector for the Township’s real estate tax.  Motion carried.

Brutscher moved, Hubbard seconded to establish checking and savings accounts at First National Bank of West Chester and Money Market Accounts at Pennsylvania Local Government Investment Trust.  Motion carried.

Sellers moved, Brutscher seconded to establish the mileage reimbursement rate at $.35 per mile.  Motion carried.

Brutscher moved, Hubbard seconded to appoint H.William Sellers as the voting delegate to the PA State Association of Township’s State Convention.  Motion carried.

Brutscher moved, Hubbard seconded to establish the following meeting dates for 2004:

2nd Monday of the month at 8:45 a.m.
4th Monday of the month at 7:30 p.m.

*            Except as follows:

      ·        Tuesday, October 12 at 8:45 a.m. (Due to Columbus Day)
·        Monday, December 13 at 8:45 a.m. (Only meeting this month)

            Township Planning Commission

3rd Wednesday of the Month at 7:30 p.m. (No August Meeting)

            Open Space Committee

2nd Tuesday of the Month at 7:30 p.m.

            Historic Committee

2nd Wednesday of the Month at 7:30 p.m.
All meetings will be held at the Township Office at 740 Denton Hollow Road.

Brutscher moved, Sellers seconded to appoint Lisa Moore as the Planning Commission Secretary at a salary of $20.50 per hour.  Motion carried.

Brutscher moved, Sellers seconded to appoint Ezekiel Hubbard as the Township’s Fire Marshall with his term to expire on December 31, 2004.  Motion carried.

Sellers moved, Brutscher seconded to appoint Karen Eckard as the Pension Plan Administrator with her term to expire December 31, 2004.  Motion carried.

Sellers moved, Brutscher seconded to appoint Karen Eckard as the Subdivision Plans Administration Officer, salary established at 50% of fees collected for applications in excess of 20 units.  Motion carried.

OTHER BUSINESS:

Escrow Release – Courts at Longwood:  Brutscher moved, Sellers seconded to authorize escrow release #13 in connection with improvements at the Courts at Longwood for all work that was completed and approved by the township engineer including inspection fees.  Motion carried with all in agreement.

Roads & Building Inspection:  Harwood presented a resolution before the Board establishing new and additional fees related to building construction in the township.

Resolution #1 of 2004:  After a review of the resolution, Brutscher moved, Sellers seconded to adopt Resolution #1 of 2004 establishing the fees for building construction in the township with the agreed upon changes.  A revised copy of the resolution will be available for signing at the next Board meeting.  Motion carried with all in agreement.

Brutscher moved, Sellers seconded to approve a $.60 an hour increase for the three maintenance employees,Bill Harwood, Scott Haines, and Wes McCoy, for the year 2004.  Motion carried with all in agreement.

Harwood discussed problems he is having this winter with salt acquisition for the roads.

Harwood reported that their have been some increased costs on the purchase of the International Dump truck that is being purchased through the PACC Cooperative Bidding program with final costs as follows:  International Dump Truck at $57,000, E.M. Kutz, Inc. accessories -Truck body, hydraulics, and snow plow, @ approximately $40,000.

Women’s Training Conference:  Sellers moved, Hubbard seconded to have Georgia Brutscher and Karen Eckard attend a Women’s Conference on March 18, 2004 in Lancaster, PA at a cost of $149 per person.  Motion carried with all in agreement.

William Waddington - Minor Subdivision Plan:  Brutscher moved, Sellers seconded to continue the review of Bill Waddington’s minor subdivision plan until March 31, 2004.  Motion carried with all in agreement.

BVA – Minor Subdivision:  After a brief discussion, the Board unanimously agreed to waive the $225.00 application fee for the minor subdivision of the Kranich property, but the Board agreed the applicant will have to pay all township engineering review fees. 

Sellers moved, Hubbard seconded to waive the township’s $225.00 application fee for the BVA’s minor subdivision application for the Kranich property located on Corrine Road.  Motion carried with all in agreement.

Conservation Easements:  Sellers said with regard to the newly adopted zoning amendments, the impact of previous conservation easements on existing property owners would have to be reviewed and discussed.  Brutscher said the Board needs to move forward on the Institutional Zoning District as soon as possible.
