Board of Supervisors Organization Meeting

Monday, January 5, 2009, 7:30 p.m.

 

Present: Stephen R. Conary, Georgia F. Brutscher, Lauressa J. McNemar, P.E.

Conary called meeting to Order at 7:45 p.m.

 

1. Announcement: Conary announced that members of the Township Historic Committee, Board of Supervisors, and Kennett Underground Railroad Center toured the Barnard House on January 4, 2009. The tour provided opportunity to view options for renovating and designating usable space for the Underground Railroad Center. 

 

2. Board Appointments and Nominations: Conary moved, McNemar seconded to appoint Brutscher as temporary Chair and Susan Simone as temporary Secretary of the Board of Supervisors. Motion carried unanimously. McNemar moved, Brutscher seconded to appoint Conary as Chair of the Board of Supervisors. Motion carried unanimously. McNemar moved, Conary seconded to appoint Brutscher as Vice Chair of the Board of Supervisors. Motion carried unanimously.

 

3. Appointments: Conary moved, McNemar seconded to appoint Susan Simone as Township Administrative Secretary at a pay rate consistent with 2009 Township Budget. Motion carried unanimously.

 

Brutscher moved, McNemar seconded to appoint Peggy Lennon as Township Treasurer at a pay rate consistent with the 2009 Township Budget.  Motion carried unanimously.

 

McNemar moved, Conary seconded to appoint Ricki Stumpo as Receptionist at a pay rate consistent with the 2009 Township Budget. Motion carried unanimously.

 

Conary moved, Brutscher seconded that the Township obtain a Treasurer’s Bond in the amount of $3,000,000. Discussion: Board reviewed the requirement that the Bond protects both the Treasurer and the Township from financial loss. Motion carried unanimously.

 

Brutscher moved, Conary seconded to dissolve designated position of a single Road Supervisor and to designate the members of the Board of Supervisors to jointly share the duties. Motion carried unanimously.

 

McNemar moved, Conary seconded to appoint Keystone Municipal Services, Inc., as Building Inspector, Building Site Inspector, Soil and Erosion Control Inspector for building permit applications at the fees established by Resolution #07 of 2006. Motion carried unanimously.

 

Conary moved, Brutscher seconded to appoint Randall Mims as Chair of the Vacancy Board with his term to expire on December 31, 2009. Motion carried unanimously.

 

McNemar moved, Brutscher seconded to re-appoint Meg Johnson and Robert Costello to the Planning Commission with their terms to expire December 31, 2012. Motion carried unanimously.

 

Brutscher moved, Conary seconded to record the following previously appointed Planning Commission members and terms:

Conary moved, McNemar seconded the following re-appointments to the Agricultural Security District Committee:

McNemar moved, Conary seconded to appoint Georgia Brutscher as Pocopson Township’s representative to the Kennett Area Regional Planning Commission, and Bruce Yelton as the alternate representative, with terms to expire on December 31, 2009.  Motion carried unanimously.

 

Brutscher moved, Conary seconded to re-appoint Robert Woodward to the Zoning Hearing Board with his term to expire on December 31, 2011. Motion carried unanimously.  It is noted that the Zoning Hearing Board must elect a Chairman.

 

Brutscher moved, McNemar seconded to record the following previously appointed Zoning Hearing Board members and terms:

Motion carried unanimously.

 

Conary moved, McNemar seconded to appoint Ross Unruh, Esquire, of Unruh, Turner, Burke and Frees, as Solicitor for Pocopson Township at the previously approved fee schedule. Motion carried unanimously.

 

McNemar moved, Brutscher seconded to appoint Fronefield Crawford, Esquire, of Montgomery, McCracken, Walker & Rhoades, as Solicitor for the Zoning Hearing Board at the previously approved fee schedule.  Motion carried unanimously.

 

McNemar moved, Brutscher seconded to appoint James Hatfield, P.E., VanDemark & Lynch, Inc. as Township Engineer at the fee scheduled submitted November 16, 2008, effective January 1, 2009. Motion carried unanimously.

 

Conary moved, McNemar seconded to appoint Castle Valley Consultants, Inc. to provide professional, civil, environmental, planning and GIS services to the Township on an as requested basis at the hourly rate in accordance with the General Contract Conditions dated January 1, 2009.  Motion carried unanimously.

 

Brutscher moved, McNemar seconded to appoint Brandywine Conservancy to advise the Open Space Advisory Board on an as needed basis at the fees to be determined on an as needed basis.  Motion carried unanimously. 

 

McNemar moved, Brutscher seconded to appoint Ezekiel C. Hubbard as the Emergency Management Coordinator, with his term to expire on December 31, 2009. Motion carried unanimously.

 

Brutscher moved, McNemar seconded to appoint William Harwood as the Township’s Fire Marshall with his term to expire on December 31, 2009. Motion carried unanimously.

 

Conary moved, Brutscher seconded to appoint H. William Sellers as Project Consultant at the fees cited in the Standard Contract for Consulting dated January 2008 on an as needed basis as approved by the Board of Supervisors. Voice vote: Conary for; Brutscher for; McNemar against. Motion carried.    

 

Brutscher moved, Conary seconded to appoint Peggy Lennon as the PMRS - Pension Plan Administrator with her term to expire December 31, 2009. Motion carried unanimously.

 

McNemar moved, Brutscher seconded to designate emergency service providers and establish the territories by resolution for response and support to Longwood Fire and Ambulance Companies and PoMarLin Fire Company. Discussion: Secretary directed to obtain documentation confirming boundary denoting territories. Motion carried unanimously.    

 

Resolution #2009-1: Brutscher moved, Conary seconded to accept Resolution #2009-1 of 2009 that establishes boundaries for fire protection in the Township between Longwood Fire Company and PoMarLin Fire Company and designates Longwood Ambulance as the EMS provider to the township and Avondale State Police Barracks as the police protection for the township.

 

Motion carried unanimously.

 

Brutscher moved, Conary seconded to appoint William Harwood as Director of Public Works at a pay rate consistent with the 2009 township budget. Motion carried unanimously.

 

McNemar moved, Conary seconded to establish holidays for the Township as follows:

           

New Year’s Day

            Martin Luther King, Jr. Day (Observed)

            Presidents’ Day                       

            Memorial Day                         

            July 4th 

            Labor Day

            Columbus Day (Observed)

            Thanksgiving

            Christmas

 

           

Motion carried unanimously.

 

Brutscher moved, Conary seconded to appoint PIRMA as the insurance broker for the Township. Motion carried unanimously.

 

Conary moved, McNemar seconded to appoint Berkheimer Tax Administrator, Inc. as Tax Collector for the Local Services Tax. Motion carried unanimously.

Brutscher moved, McNemar seconded to appoint Central Tax Bureau of PA, Inc. as Tax Collector for the Township property taxes. Motion carried unanimously.

 

Resolution #2009-2: Conary moved, McNemar seconded to accept Resolution #2009-2 of 2009 that authorizes the Treasurer to pay utilities, insurance, and other bills that shall accrue a penalty.

 

Motion carried unanimously.

 

Resolution #2009-3: Conary moved, Brutscher seconded to accept Resolution #2009-3 of 2009 that authorizes Public Works staff, Administrative Secretary, and Treasurer to purchase goods and services required on an immediate or emergency basis for Township operations, or when purchasing from a vendor who will not invoice the Township for subsequent payment.

 

Motion carried unanimously.

 

Resolution #2009-4: Conary moved, McNemar seconded to accept Resolution #2009-4 which in accordance with the Second Class Township Code establishes the following depositories for Township Funds

¢     First National Bank of Chester County for regular banking and for select investment accounts; and

¢     PLGIT (Pennsylvania Local Government Investment Trust) for select investment accounts.

 

Motion carried unanimously.

 

Conary moved, McNemar seconded to establish mileage reimbursement at the IRS approved rate of 55¢ per mile. Motion carried unanimously.

 

Brutscher moved, Conary seconded to appoint Lauressa J. McNemar, P.E., member of the Board of Supervisors, as the voting delegate to the Conventions sponsored by the Pennsylvania State Association of Township Supervisors and the Chester County Associations of Township Officials. Motion carried unanimously.  

 

4. Township 2009 Meeting Dates: Conary moved, McNemar seconded to establish the meeting dates for 2009 as follows:

 

Board of Supervisors will meet on the 2nd and 4th Mondays of each month at 7:30 p.m., except as follows:

·        Tuesday, May 26, 2009 (due to Memorial Day)

·        Tuesday, October 13, 2009 (due to Columbus Day)

 

Township Planning Commission

3rd Wednesday of each month at 7:30 p.m. (No August meeting)

 

Historic Committee

2nd Wednesday of each month at 7:30 p.m.

 

Parks, Recreation and Trails Committee

2nd Tuesday of each month at 7:30 p.m.

 

Open Space Advisory Committee

Thursdays, as needed, at 4:00 p.m.

 

All meetings will be held at the Township Office at 740 Denton Hollow Road.

Motion carried unanimously.

 

5. Assignment of Supervisor Liaisons to Township Committees: Following discussion, the Board agreed to the following assignments:  Open Space Advisory – Conary; Historic – Brutscher; Parks, Recreation and Trails – McNemar; Planning Commission - McNemar

 

6. Treasurer’s Warrants: Warrants were reviewed and approved as submitted. 

 

7. Correspondence:  Board recognized a contribution from Bruce Yelton for the Schoolhouse Fund.

 

8. Other Business: Hubbard asked if Founders Day Committee remains a subcommittee of Park, Recreation and Trails Committee? The Board agreed that Founders Day Committee remains a subcommittee and directed Hubbard to provide proper oversight of 2009 activity. Brutscher noted that an opening remains for a Pocopson Township resident appointment to the Scenic Byways Commission. McNemar offered to contact residents who may be interested.

 

9. Adjournment: At 8:35 p.m., Conary moved to adjourn the meeting; Brutscher seconded.
