Board of Supervisors' Meeting Minutes

8:45 a.m., Monday, January 8, 2007

  Brutscher opened the meeting with the pledge of allegiance at 8:45 a.m.  Supervisor Hubbard was present.  Bill Harwood, Road Master, was also present.

Motion:  Hubbard moved, Brutscher seconded to close the Regular Meeting at 8:45 a.m.  Motion carried.
Brutscher said this ordinance was advertised in the “Daily Local News” on December 12 and 19, 2006. 
Motion:  Brutscher moved Hubbard seconded to adopt Ordinance #01 of 2007 which amends Article VI, Flood Plain Conservation District, of the Pocopson Township Zoning Ordinance of 1972 to modify certain definitions; change certain references; and otherwise modify the ordinance to comply with the requirements of the federal emergency management agency (FEMA) in order to qualify the township for eligibility in the National Flood Insurance Program. 
Motion carried.

Motion:  Hubbard moved, Brutscher seconded to reopen the regular meeting at 9:47 a.m.
Motion carried.

Announcements: 
Brutscher reported she had attended the Scenic Byway Meeting last Thursday night.  Brutscher said the committee is preparing a comprehensive plan for the management of the Byways.  Brutscher noted that dues of $500 should be paid in February.

Supervisors Sellers entered the meeting at 8:55 a.m.

Serum Property – Minor Subdivision:  Fritsch was present to discuss the Serum property minor subdivision plan dated 1/3/07.  Fritsch reported the PC had recommended final plan approval at their last meeting.

Sellers said the existing house and the new parcel that would be created should be deed restricted against further subdivision and the applicants should place deed restrictions on the recorded subdivision plans.  Harwood reported he had reviewed the driveway construction and said it is satisfactory to township standards.  Fritsch said the Shared Driveway Maintenance Declaration has been submitted to the PC along with the legal descriptions.  Sellers noted that in subdivisions with conservation easements, the applicants do not pay a fee-in-lieu of.  Brutscher suggested the Serums pay for the construction of the trail improvements on their property.  The board agreed with this suggestion.

Motion:  Brutscher moved,  Sellers moved to grant the following waivers from the SDLDO of Pocopson Township to the Serum property minor subdivision: 
190-22.C         Requiring a final improvement construction plan.

190-23                         Requiring an existing resources and site analysis plan.

190-24                         Requiring a conservation plan.

190-30.B(2)     Requiring the shared portion of a common driveway to be constructed to
                        township street standards for pavement depth.
190-35             Requiring landscape design.

190-40                         Requiring concrete monuments to be placed at all perimeter corners.

Motion carried.

Motion:
  Brutscher moved, Hubbard seconded to grant final plan approval to the Serum minor subdivision plan dated 1/3/07 with the following conditions:

1) Deed restrictions on both lots against further subdivision

2) Storm water management plan submitted at the time of building permit issuance.

3) Solicitor’s approval of Shared Driveway Maintenance Declaration.

4) Construction of pull-off area on the driveway in front of the ruins.

5) Cash contribution of $2,500 or install the trails on this property at the time of building permit issuance.
Motion carried.

Route 52:  The Board discussed sending a letter to PennDOT requesting a meeting to discuss safety checks on the portion of Route 52 in front of the Lenape Village Shops A copy of this letter should be sent to KARPC, Representative Barrar, & Senator Pileggi. Brutscher said she would discuss this problem at the KARPC next Tuesday night. 

Intersection Locust Grove Road & Route 52:  Jim Brandolini, Scott Megill, and Jim Fritsch, Regester Associates, Inc. were present.  Fritsch said the plans are showing the decel lane heading south on Route 52.  Fritsch said the applicant will be shaving the bank back looking to the north to improve sight distance.  Fritsch said the applicants have agreed to make a cash contribution to the township for future road improvements at this intersection.  Fritsch said the applicant did receive PUC approval to extend the water line into Scaleby Farms.  Sellers suggested a contribution of $5,000 per house to the road improvement project by each developer.  After a discussion with the Board of Supervisors, the following motion was made: 

Motion:  Sellers moved, Brutscher seconded to have the developers of Scaleby Farm and the Baily Farm make a cash contribution to the township of $225,000 for intersection improvements at Locust Grove Road and Route 52 or at Route 52 and Lenape-Unionville Roads with a major portion of the total to be held in an interest-bearing account and restricted for use in improving the Locust Grove intersection at such time as the township shall have adequate funds; two thirds of the contribution coming from  Jim Brandolini and Robert Bruce Balbirnie, and one third of the contribution coming from Scott Megill, Megill Homes.  This contribution takes the place of the decel lane. 
Motion carried.

Brandolini and Megill agreed to share the costs of the engineering design for the intersection.  Sellers noted that Megill Homes (Scaleby Farms) shall pay the costs of shaving the banks back to improve sight distance at this intersection.  The Board noted the radius of the entrance to Locust Grove Road should be widened to accommodate school buses. 

Olmsted – Phase 3A:  Hubbard reported that the survey issues that were raised along the proposed right-of-way lines of Maentel Drive, Northbrook Road, and Route 842 have been satisfactorily addressed by John Fenn’s letter dated December 28, 2006. 

Motion:  Hubbard moved, Sellers seconded to release the $4,000 remaining escrow after all outstanding invoices are paid.   Motion carried.

Roads Report: 
Harwood said Mr. Becker is suing the school district over storm water issues and would like the township to pay for John Fenn to attend the meeting on Friday morning at 9:00 a.m. at the site.  Hubbard said he was planning to attend.  Sellers asked Hubbard to remind Rick Hostetler about moving the trail and the wastewater treatment plant that will be connected to the Toll Brothers sewage treatment facility.

Harwood reported he had walked the property in back of Lenape Forge, and there are drains located at the back of the building but the area was usable for a sewer line from Simon Pearce to our treatment plant.   

Sellers noted that the sewer connection for the Forge and Simon Pearce cannot run through the wetlands located on the Forge property.
Harwood reported he had been working on the school house, and reported that he had asked John Esh (contractor) to replace the rotted roof rafter in the school house.  Sellers asked Harwood to make sure that Mr. Esh takes out the old heating system and the dilapidated chimney. 

Larkin Baily Road - Closing:  Brutscher suggested inviting the residents affected by the Larkin Baily Road closing to a township coffee to sign the road closing agreements once they have been prepared by the solicitor.  The members agreed.

Minutes of December 11, 2006: 
Brutscher moved Sellers seconded to approve the minutes of December 11, 2006 as amended.  Motion carried.

Treasurer’s Warrants:  The Board agreed to sign the warrants outside of a public meeting. 

Executive Session:  Sellers moved, Hubbard seconded to close the public meeting at 10:00 a.m. to discuss legal matters.   

Adjournment:  The meeting was adjourned at 10:50 a.m.
