Board of Supervisors' Meeting Minutes

7:30 p.m., Monday, January 23, 2006

   
Sellers called the meeting to order at 7:40 p.m. and opened with the pledge of allegiance.  Supervisors Hubbard and Brutscher were in attendance.

Ordinance Hearing: 

Motion:  Sellers moved, Hubbard seconded to close the regular meeting at 7:42 p.m. and open the hearing to consider ordinance #01 of 2006 which enacts a 1 mil tax for the acquisition of open space in the townshp.
Motion carried.

Sellers said the proposed ordinance was advertised in the “Daily Local News” on January 2, 9, and 16, 2006.

Sellers reviewed Ordinance No. 1 of 2006 Sellers for the meeting attendees said the proposed 1 mil tax can only be used for the acquisition of open space.  Sellers said there is a sunset provision in the ordinance that specifies the collection of funds will end in five years if there is no financial obligation assumes by the township due to open space acquisition.

Motion:  Brutscher moved, Hubbard seconded to adopt ordinance #1 of 2006 that places the open space referendum before the voters of Pocopson Township on May 16, 2006 primary ballot.  If passed, this referendum would enact a 1 mil tax increase to be used solely for the purpose of open space acquisition. 
Motion carried with all in agreement.

Motion:  Sellers moved, Hubbard seconded to reopen the regular meeting at 7:50 p.m.  Motion carried.

Announcements:  Brutscher announced that she had attended the KARPC meeting and the TMACC was discussed.  TMACC has indicated they are willing to help the region get PennDOT support for improvement projects.  A Representative from SAVE made a presentation and included a picture of the Pocopson Township’s proposed roundabout.

Chester County Prison Property:  Second Addendum to Intergovernmental Cooperation Agreement between the County of Chester and Pocopson Township:

Motion:  Sellers moved, Brutscher seconded to accept Resolution #04 of 2006, which accepts the second addendum to the Intergovernmental Cooperation Agreement between the County of Chester and the Township of Pocopson; but, further noted that in signing this agreement the township will work with the applicant on the minor subdivision as long as it is consistent with the township subdivision and zoning ordinances that are in effect.
Motion carried with all in agreement.
 

William Waddington / Minor Subdivision:  William Waddington was present with his plan for a minor subdivision drawn by Regester Associates, Inc. Dated 7/13/04, Revision 1/23/06.  Waddington reviewed the changes to the plan, and presented to the Board with the conservation easement and the shared driveway maintenance and construction agreement.  Sellers noted that when there is a subdivision of a preexisting residential property, there is no provisions in the existing ordinance to provide for storm water management and the existing septic system.  Sellers said wording should be developed and incorporated into the ordinance to address storm water management and ensure that the existing septic system is inspected for adequacy.  The Board members agreed.

Brutscher suggested that the Planning Commission discuss this issue and consider developing a draft ordinance to be presented to the Board at a future meeting.

MotionBrutscher moved, Hubbard seconded to grant final plan approval of William & Darlene Waddington’s Minor Subdivision Plan drawn by Regester Associates, Inc., dated 7/13/04, revised 01/23/06 with the attached conservation easements and shared driveway agreement.  Chester County Conservation District approval must also be received by the township.  Motion carried.

Route 52 - Scenic Byway:  Brutscher said the township’s solicitor is reviewing an ordinance that  will form a byway commission and each municipality included in the Scenic Byway route will have a representative on the commission.  Brutscher said the commission is necessary in order to apply for state and county funding for Byway improvements.  Brutscher asked the members to sign the letter of intent tonight and said Unruh’s comments on the ordinance would be available by the next Board meeting.  The members agreed to sign the letter.

Motion:  Sellers moved, Hubbard seconded to approve and sign the letter of intent for the Scenic Byway (Route 52) dated January 23, 2006.  Motion carried. 
Brutscher asked the secretary to forward this letter to Alma Forseth at Pennsbury Township. 

Gawthrop / Minor Subdivision Plan:  Jake Diem, Regester Associates; and the Gawthrops were present.  Diem said the township’s solicitor, Ross Unruh, advised that the additional right-of-way was not required for a lot line change, but the Open Space Committee would like a 10’ trail easement along Bragg Hill Road.  Diem said the Gawthrop’s were in agreement with the trail easement request.  The Board agreed to approve the minor subdivision plan and the waiver request with the following two conditions:

Waiver:
Motion:  Sellers moved, Hubbard seconded to grant a waiver from Subdivison/Land Development Ordinance Section 109.29-11C noting that additional right-of-way will not be required for this minor subdivision.  Motion carried.

Approval:

Motion:  Brutscher moved, Hubbard seconded to grant final plan approval of the Gawthrop Minor Subdivision Plan dated 9/15/05, Revision 01/19/06 with a 10’ trail easement along Bragg Hill Road shown on the plan and the granted waiver noted on the plan.  Motion carried with all in agreement.

Baily Farm/Corinne Village: Frone Crawford, Esq.; Jim Brandolini, Developer; Frank Smith, Apex Engineering;   Crawford said the applicant is requesting preliminary plan approval tonight. Crawford said the applicant has agreed to address all issues in Fenn’s review of  01/04/06, the terms of the conditional use agreement, and all county agency approvals.  Brutscher expressed concern that there were still so many outstanding issues on Fenn’s review letter.  Crawford went through the review letter with the Board item by item.  Brutscher asked if the plan had been submitted to the fire company.  Smith said that Apex was going to submit to Longwood Fire Company as soon as John Fenn gave final approval of the entrance design.  It was noted that there are fire hydrants in the community.  Smith reviewed the six parking pockets on the plan located on Corinne Road.  The parking pockets are taking the place of a decel lane.  Sellers asked if the mailboxes were going to be clustered.  Brandolini said he would look into clustering the mailboxes if that is what the township would like.  Brandolini said they were going to put plaques on columns at the entrance.  Crawford said the trail easements and conservation easement agreements on the Baily Farm / Minor Subdivision have been drafted. 
MotionHubbard moved, Brutscher seconded to grant preliminary plan approval of the Baily Farm / Corinne Village plan, drawn by Apex Engineering Incorporated, dated 02/12/04, revision 12/7/05, with the following five conditions: 

1.  Three previously granted  waivers  indicated on the plan.
2.  John Fenn’s letter of January 4, 2006 as amended with comments made during this meeting.
3.  All Trail easements shown on the Baily Farm minor subdivision plan.
4.  HOA documents reviewed and accepted by the township’s solicitor.
5.. All state and county permits received by the township.

Motion carried with all in agreement.

Open Space Committee – Appointment: 
Motion:  Hubbard moved, Brutscher seconded to appoint Joe Stumpo to the Open Space & Recreation Committee.  Motion carried. 
The Board agreed additional members need to be appointed to the committee from other areas in the township. 

Approval of Minutes - January 9, 2006:  Brutscher moved, Hubbard seconded to approve the minutes of January 9, 2006 as amended.  Motion carried.

Treasurer’s Warrants:  The warrants were approved and signed as submitted. 

Adjournment:  The meeting was adjourned at 9:55 p.m.
