Board of Supervisors’ Meeting
7:30 p.m, Monday, February 23, 2004
Brutscher opened the meeting at 7:36 p.m. with the
pledge of allegiance. Supervisors Sellers and Hubbard were in
attendance. Also in attendance was Building Inspector and Zoning Officer,
Bill Harwood.
Announcements: Hubbard announced that Sellers and himself would be
attending the CCATO Convention in March.
Open Space Committee: Hubbard said he would
be presenting several letters from the OSC to the Board at their next
meeting.
Public Comment: (15 residents from the
Hickory Hill Road location of the township were in attendance) A resident
reported that Brandon “Bam” Margera has purchased the farm on Hickory Hill
Road. The resident reviewed the list of activities that has occurred on
the property since Mr. Margera has taken ownership such as parties with a
live rock band, bonfires, constant stream of traffic, buses full of people
attending the parties, proposed construction of a skateboard park, filming
of a television production, large outdoor lighting, etc. Hubbard said the
Board had met with the township attorney last Friday to discuss what can
be done about the noise, traffic, and filming of his TV show which may be
in violation of the home occupancy zoning. The Board discussed this
problem at length with the residents and advised them that the Township
Solicitor was reviewing the ordinances to see how to address this
problem. Brutscher also informed the residents that a noise ordinance was
currently being proposed, and most likely, would be adopted by the end of
March. Harwood said any complaints should be directed to him or if a fire
is illegally occurring, the Fire Marshall, Zeke Hubbard, should be
contacted. The residents thanked the Board for their time.
Winterwood / Megill: Jim Fritsch, Regester
Associates, Inc., and Scott Megill presented a revised plan for the
Winterwood Subdivision dated 2/19/04. Fritsch said he would like to
discuss three outstanding issues, and proceeded to request waivers that
would be needed for this subdivision. Sellers asked about the open space
and conservation documents. Megill agreed to submit these documents.
Sellers asked about the two lots that have a proposed drip irrigation
system, and said he didn’t feel homeowners are sophisticated enough to
handle this type of system and did not like to see this type of system
used in the township. Megill said the company that installs the drip
irrigation system walks the homeowner through the operation and
maintenance of the system. Sellers and Brutscher agreed that they wanted
to see an alternative to this type of system. Sellers proposed putting
the septic system in the open space of this subdivision. Fritsch stated
that Lot #2 was the only lot with a primary drip irrigation system, and it
could possibly be a standard system if the effluent was pumped up to the
open space. Brutscher said she would like to see an alternative to the
back up sand mound on Lot #7. The Board agreed that Lot #2 will need to
have a standard septic system for the primary system possibly by putting
the septic system in the open space. Sellers said the construction
agreements, homeowners’ documents, conservation easements, (which should
include language in the homeowners’ documents that includes the verbage
that “septic systems will be permitted in the open space if the primary
system fails” need to be submitted for the Winterwood Subdivision for
review by the township’s solicitor. Also noted will be a deed restriction
on lot #4 against cutting or removing of the two specimen (50” Sycamore
and 36” Maple) trees that are located near the front of this lot.
Sellers moved, Hubbard seconded to grant the
following two waivers to the Winterwood Subdivision plan last revised
2/19/2004:
Section 612.2.G Requiring a septic tank, tile field or other
effluent disseminating system to be located twenty (20) feet from a
property line.
Section 615.3 Requiring an easement for discharge from the
existing drainage pipes crossing Valley Road and discharging onto the
Beversrede Homeowners Association Open Space.
Motion carried. Brutscher was opposed.
Brutscher moved, Hubbard seconded to grant an extension until
March 23, 2004 to continue the plan review and give the applicant time to
address remaining issues. Motion carried with all in agreement.
Regester Associates, Inc.: Sellers moved, Hubbard seconded to
accept the bid of Regester Associates, Inc. dated February 5, 2004 to
survey the Hipkins’ trail easement and place monuments along the trail for
a sum of $1,080.00. Motion carried with all in agreement.
Noise Ordinance: Brutscher reported that the noise ordinance is
currently being reviewed by the Township Solicitor. Bruce Yelton asked
the Board how they planned to enforce this ordinance. Sellers said the
Zoning Officer would enforce the ordinance.
Earned Income Tax: The Board discussed implementing an earned
income tax. No decisions were made.
Other Business: Yelton asked how he could get his property added
to the agricultural security district. Sellers said Yelton would need to
write a letter requesting the Board to consider his property for the
agricultural security district.
Minutes of February 9, 2004: Sellers moved, Brutscher seconded to
approve the minutes of February 9, 2004 as corrected. Motion carried.
Treasurer’s Warrants: The warrants were approved and signed as
submitted.
County - Tobacco Shed: Brutscher reported that Hubbard and herself
had met with Mr. Esh, an Amishman, and the County Structural Engineer
about replacing the roof on the tobacco shed and pulling the building back
on its foundation. The engineer will be contacting the County with the
information and estimates for the repairs.
