Board of Supervisors' Meeting Minutes

8:45 a.m., Monday, March 12, 2007

    Brutscher called the meeting to order at 8:45 a.m.  Supervisor Hubbard was in attendance.  Conary, Planning Commission Member, and Randy Mims, Open Space Advisory Committee, were in attendance.

Announcements:  Hubbard announced he was holding a meeting on March 21, 2007 with Tom Kessler of Toll Brothers, Inc., and Rick Hostetler of the Unionville-ChaddsFord School District to discuss the trail easement on the Pocopson Elementary School Property.

Brutscher said she had attended the Pocopson Historic Committee, the Planning Commission, the Open Space Advisory Committee and the Scenic Byways Commission. Brutscher reported the Open Space Advisory Committee presented their Open Space Priorities Protection Plan to the Planning Commission at the February meeting.

Brutscher also reported she had attended the KARPC Meeting.  It was noted at the meeting that housing development was slowing.  Brutscher said New Garden Township has the most subdivision plans in the approval stage. 

Brutscher also reported the Scenic Byways Committee has received several grants, and the committee is currently working on a comprehensive plan.

Historic Committee:  Brutscher reported that Bernard Baily is supervising the roof -replacement project on the Locust Grove schoolhouse.

Supervisor Sellers entered the meeting at 8:50 a.m.

Open Space Priorities Protection Plan:  Steve Conary and Randy Mims, Open Space Advisory Committee members, presented an overview of the Open Space Priorities Protection Plan and the Open Space Protection Opportunities Map and future amendments and answered questions for the BOS.  Conary said the township’s Planning Commission has recommended adoption of this document.  After a brief discussion, Sellers reviewed Resolution #03 of 2007.

Motion:  Brutscher moved, Hubbard seconded to adopt Resolution #03 of 2007 which accepts the Open Space Priorities Protection Plan and the Open Space Protection Opportunities Map.
Motion carried.  All in agreement.

Road Report:  No report.  Harwood was not present.

Other Business:  Sellers reported the township had received a recycling grant for 2006 in the amount of $2,953.00.  Brutscher said she is assisting with the Open Space Meeting at the Brandywine Valley Association being held in April.  Brutscher also reported the township has received a thank you letter from the West Chester Library for the township’s 2006 contribution.

Sellers reported the Roundabout project has been awarded federal funding in the amount of $900,000.

PennDOT is requesting the township to appoint a project manager for the Route 52 bridge replacement project.

Sellers reported the Beversrede Development has requested the township to repair a stormwater basin.  Sellers said the responsibility for the repair of the basin lies with the HOA.  Brutscher said she would research the documents and write a letter to the Beversrede HOA. 

Meeting Change:  The Board discussed changing the next meeting date since two supervisors would not be available.  The Board agreed the March 26 meeting will change to Tuesday, March 27th at 7:30 p.m.  The secretary will advertise the changed meeting date.

Riverside/Toll Brothers – Trail Easements:  The BOS and residents, Chris & Peggy Conaway discussed the trails on the Riverside plans.  Hubbard suggested the solution to this issue would be to return to the original agreed upon trail easements.  Hubbard reported he would meet with Tom Kesseler, Toll Brothers Inc., and Rick Hostetler, Unionville-ChaddsFord School on March 21st to resolve trail issues.  Hubbard also pointed out the township will need to secure a trail easement connection along Route 52 from Toll Brothers, Inc.
Sellers said Ross Unruh, Township Solicitor, should recheck the original settlement agreement with Toll Brothers to determine what is required by the agreement.

Historic Committee Meeting:  Brutscher said she had attended the Historic Committee Meeting, and the members expressed concerns about their committee’s membership.  Brutscher said the committee also has question’s about the appropriate procedures for spending funds allocated from the township’s budget.  Brutscher said the committee would like to come before the BOS and present their by-laws and select voting members of their committee. 

 Minutes of February 26th , 2007:  Brutscher moved, Sellers seconded to approve the minutes of February 26th  as amended.  Motion carried.

Open Space Advisory Committee – Hosting April Meeting:  Conary reported the Open Space Advisory Committee will be hosting a meeting at the Baily Farm in early April with possible land candidates for the Open Space Program.  Conary said he is sending out a letter this week to all residents in the township outlining the program and informing them the entire program along with the open space green properties map will be available on the township website by week’s end. 

Riverside/Toll Brothers – Legal Agreements:  Ross Unruh, township solicitor, met with the board to discuss issues related to the Toll Brothers settlement and legal documents related to the handling of sewage matters at the Riverside Community.
