Board of Supervisors’ Meeting
 

7:30 p.m., Monday, March 28, 2005

     Brutscher opened the meeting with the pledge of allegiance at 7:35 p.m.  Supervisor Hubbard was in attendance.   Supervisor Sellers entered the meeting at 7:40 p.m.

Announcements:
  Hubbard said he had attended the KARPC meeting, and the committee is working on securing funding for intersection improvements.

Open Space Committee:  Hubbard reported that the open space committee held a work session.

Planning Commission Report:  Waddington said at the last PC meeting in March the committee had discussed Fenn’s review of the Baily Farm dated March 9, 2005.  Waddington said the PC is concerned as is John Fenn about the failure of the embankments on the swales behind the houses located on Road B on the plan to sufficiently hold storm water during rainfalls.  Waddington said they are hoping to see a revised plan on the Baily Farm/Corinne Village addressing issues raised in Fenn’s review.  Waddington also reported that the committee had reviewed the minor subdivision plan for the County Prison property, and discussed the township’s trail easement on this property and maintaining township access to the barn. 

West Chester Library:   Pete Dalton and Victoria Dow were present to thank the Board personally for the $11,000 contribution to the library from Pocopson Township.  Mr. Dalton said the township has 1,200 cardholders who live in Pocopson Township.  Mr. Dalton said the last serious expansion to the library was done in 1960.  Ms. Dow said there are plans to expand the children’s programming and develop new adult programs.  Ms. Dow said she would submit an article to the township for inclusion in their spring newsletter.

Public Comment: 
Bill Anderson and John Harms, residents from Northbrook Road were present to complain about flooding coming from Olmsted subdivision.  Mr. Anderson said the flooding has increased considerably since the construction of the Olmsted Subdivision.  Hubbard said he would contact Representative Barrar’s office again about requesting the state to install a pipe down Northbrook Road to help control the run off coming down Northbrook Road and flooding out these homes.  Harwood said the township will not sign off on the Olmsted subdivision until all drainage issues at Olmsted are corrected.  Sellers said the 18 month maintenance bond for Olmsted could include money to correct any drainage problems.  Sellers said the township engineer will need to review the calculations for Olmsted and develop measures to correct the problem from Olmsted to reduce storm water discharge or correct the problem by installing a pipe further down on Northbrook Road.  Harwood said PennDOT will have to open up the clogged cross pipe on Northbrook Road and said he would contact them tomorrow.  Harwood said he could investigate the possibility of the township taking ownership of the road from PennDOT, and then the township could make the necessary repairs to the road to help eliminate the storm water problem.   Sellers said the residents should check back with the Board in two weeks and thanked them for coming in. 

Ordinance No. 1 of 2005:  Brutscher moved,  Hubbard seconded to adopt Ordinance #01 of 2005 amending Ordinance No. 4 of 1985, The Pocopson Township Occupational Privilege Tax Ordinance to change the name of the tax to “Emergency and Municipal Services Tax,” to increase the exemption amount to $2,000, to increase the amount of the tax from $10 to $52, and to replace reference within the ordinance to “Occupational Privilege Tax” with “Emergency and Municipal Services Tax.” 
Motion carried with all in agreement.

Thomson Property / Bragg Hill Road:  The Board discussed the zoning restrictions on the Thomson property and decided that Brutscher and Harwood would do the research to determine what size house would be allowed on this property along with the existing accessory dwelling located in the barn.

Haines Mill Road / One Way:  Brutscher said a traffic study is going to be necessary to maintain Haines Mill Road as one way.  Harwood said he had contacted Traffic, Planning &Design, Inc. and asked them for a cost estimate on conducting a study.  Harwood said the road was closed this winter due to the 8’- 9’ cartway.

Sellers moved, Brutscher seconded to maintain Haines Mill Road as one-way due to the increased traffic in the area until after a traffic study has been completed.   Motion carried with all in agreement.

Fiber Optic Network:  
Sellers said the township should update the cable ordinance and broaden it to include fiber optics as Verizon is installing a fiber optic network that should be available for services to residents in the near future. 

County Prison / Intersection Improvements:  Sellers reviewed an email from Don Thompson, Chester County, owner’s representative, with the Board and discussed the proposed roundabout and the sewage facility improvements.  Brutscher suggested inviting Mr. Thompson to the next morning meeting.

Other Business: 
Sellers said the Historic Committee should be invited to attend the April 25th Board meeting to discuss developing a charter for the committee.

Brutscher said the Board met last Monday, March 23 to discuss the Codification of the ordinances and address the comments made by General Code.  The secretary reported that the definitions had been reviewed, and there were several corrections that will need to be made. 

Approval of Minutes - March 7 and March 14: 
Brutscher moved,  Hubbard seconded March 14 with corrections.  Motion carried.  Sellers abstained as he did not attend.

Brutscher moved, Hubbard seconded to approve the minutes of March 7 as submitted.  Motion carried with all agreed.

Treasurer’s Warrants:  The warrants were approved and signed as submitted.

Georgia Brutscher exited the meeting at 9:50 a.m. to recuse herself from any discussions on the issues below. 

George & Georgia Brutscher / Minor Subdivision:  Sellers said the Brutschers’ subdivided their property, and the subdivision was approved on December 11, 2000.  At that time, much of their land was placed under conservation easement.  Subsequently, the township ordinance has changed, and this change will make their property non-conforming.  To address this issue, the Board adopted the following resolution:

Sellers moved, Hubbard seconded to the adoption of Resolution #04 of 2005 that grants an extension of the three lot subdivision plan of George A. and Georgia F. Brutscher, dated August 24, 2000, last revised November 29, 2000, and approved by the Board of Supervisors on December 11, 2000, is hereby granted a five year extension of plan approval from December 11, 2004; thereby extending plan approval until December 10, 2009.
Motion carried.

Pennwycke Subdivision:  Sellers and Hubbard discussed the settlement of the litigation of the Pennwycke subdivsion.  Sellers noted that it has been the township’s understanding throughout this project that Lot #1 will be deed restricted to one principal residence and accessory apartment with no further subdivision.
