Board of Supervisors' Meeting Minutes

8:45 a.m., Monday, April 9th, 2007

  Brutscher called the meeting to order at 8:50 a.m. and opened with the pledge of allegiance.  Supervisors Sellers and Hubbard were in attendance.  Bill Harwood, Roadmaster, and Steve Conary, PC member, were also in attendance.

Announcements: 
Hubbard reported that Georgia Brutscher and himself has attended a document signing session with residents of the township for the Larkin Baily Road closing last Thursday at the township office.  Hubbard said two residents had not attended.  The secretary will be contacting them this week to get signatures.

Brutscher reported that Hubbard is attending the Kennett Area Regional Planning Commission this month.

Trails Project:  Bob Flinchbaugh, Regester Associates, Inc.,  Flinchbaugh reported there is possible Bog Turtle habitat along the proposed trail project.  Flinchbaugh also said this plan will have to be submitted to the CCCD.  The majority of proposed trails are located in a wetlands delineation area.  Flinchbaugh said there will need to be a wetlands delineation completed for the trail project.  Sellers asked Flinchbaugh to get a Phase 2, bog turtle study completed for the area.  The Board agreed.  Lanchester Soil Consultants, Inc. has submitted an estimate on percolation testing for the proposed trail system of $2,380.00.  Sellers suggested piggybacking this testing onto the percolation testing that will be required for the proposed Roundabout project and using the same stormwater structures for both projects.  Flinchbaugh said he would contact John Fenn, Township Engineer, for a copy of the roundabout plan.  Flinchbaugh handed out the Vortex Environmental contract on wetlands delineation for the trail project.  The Board discussed the location of the trails on the plan and made some adjustments to have the trails avoid wetland areas.  The Vortex Environmental work is estimated to cost $1,350.  This testing should cover the DCNR requirements along with DEP requirements  The Board agreed to limit the scope of the Vortex project to the two stream crossings at a cost not to exceed $900.  Flinchbaugh said two species of rare grasses have been identified along the proposed trails.  Janet Ebert has submitted a proposal for 4 to 6 hours in the field and 2 hours for the preparation of a report, not to exceed $400.  This report will define the exact location of the grasses.  If rare grasses are found, the area will be flagged and a representative from the township will go into the field to determine how best to address the situation.  The Board agreed Janet Ebert should do the study.

Brandywine Hardware Store:  Richard Moore was present and said he had applied for a permit for a new sign for Brandywine Power Equipment.  Mr. Moore said he was removing the two existing signs to install a new 5x6, 30 square foot sign for Brandywine Power Equipment.  Mr. Moore reviewed his landscape plan for the Board and discussed several improvements he had planned for the building.  Sellers suggested planting trumpet vines along the fence and installing a lattice against the building with trumpet vines to soften the lines of the building.  Harwood said the handicapped parking area is not always available, and there is not enough parking available because equipment and palettes are being stored outside.  The Board agreed this is a zoning hearing board matter.

The Board discussed allowing Moore to install the sign temporarily for his open house later this week, but he would still have to go before the ZHB for a variance.  Mr. Moore said he was not going to install the sign because it would have to be cemented in and would be very hard to remove if the variance request was turned down.  Mr. Moore said he will file an application with the Zoning Hearing Board, and thanked the Board for their time.

Resolution #04 of 2007:  Hubbard moved, Brutscher seconded to accept Resolution #04 that sets the fees for erosion and sediment control at $200 with a re-inspection fee of $75 per inspection.  Motion carried. 
The resolution will be signed outside of a public meeting.

Historic Schoolhouse Sign:  Brutscher said the historic Committee is proposing a sign at the schoolhouse for a fundraiser.  It was noted the size of the sign should meet township ordinance.  Conary looked up the requirement and said the sign can be 60 square feet with a maximum height of 8 feet.  Brutscher said she would communicate this to the committee, but she felt the proposed sign would meet the township requirements.

Treasurer’s Warrants:  The warrants were signed and approved as submitted with one minor correction. 

Minutes of March 26, 2007:   Brutscher moved, Sellers seconded to accept the minutes of March 26, 2007 as amended.  Motion carried.

Adjournment:  The meeting was adjourned at 10:25 a.m.
