Board of Supervisors’ Meeting
8:45 a.m., Monday, April 12, 2004
Sellers opened the meeting at 8:51
a.m. with the pledge of allegiance. Present were Supervisors Brutscher
and Hubbard; Solicitor, Ross Unruh; Township Engineer, John Fenn; and
Building Inspector and Zoning Officer, Bill Harwood.
Announcements: Hubbard said he is attending the emergency
management training session this month at the Unionville High School.
Open Space Committee will meet tomorrow night.
Sellers said he had attended the Save 41 meeting. Sellers announced that
he and Unruh had met on Friday, April 9th to discuss Toll Brothers sewage
issues, and how funding will be achieved. Unruh said the final details of
funding the sewage facility will be handled by the end of the month.
Winterwood – Final Plan: Jim Fritsch, Regester Associates; Art
Sagnor, Legal Counsel; and Scott Megill, Megill Homes, Inc.; were present
to review the final plan. Jim Fritsch said that two standard sewage
systems had been located on Lot #2 as the Supervisors had requested.
Fritsch said the homeowners documents had been submitted to the township,
and their solicitor for their review. Art Sagnor reviewed notes 34 and 35
on the plan and asked the board how they wanted these items worded. Unruh
said the language dealing with seepage beds should be further defined for
the homeowner and also maintaining storm water facilities will be the
developer’s responsibility until the road is dedicated to the township.
Brutscher said there should be a declaration in the homeowner’s deed
outlining the maintenance of a drip irrigation system and/or a sand
mound. Sellers said once the legal documents get approved, the Board
should be able to give final plan approval at their next meeting in
April. Sagnor said Lot #2 will require a easement for their septic
systems to be located in the open space. The Board agreed.
Brutscher moved, Sellers seconded to extend the final
plan review of Winterwood until May 27, 2004. Motion carried. All in
agreement.
Brutscher moved, Hubbard seconded to close the
regular meeting at 9:16 a.m. to open the hearing.
Noise Ordinance/Public Hearing: Unruh said
the ordinance had been advertised on Monday, April 5, 2004 in ‘The Daily
Local News’. Sellers briefly reviewed the details of the ordinance
for the meeting attendees. After a brief discussion, the Board
unanimously agreed to adopt the ordinance.
Brutscher moved, Hubbard seconded to adopt Ordinance
#01 of 2004 which regulates noise in the township. Motion carried with
all in agreement.
Brutscher ratified that Unruh, Turner, Burke & Frees
have been authorized to advertise amending the zoning chapter of the
Pocopson Code and the Subdivision and Land Development Chapter of the
Pocopson Code to permit additional uses by conditional use under Article V
in the C-1 Neighborhood Commerical District.
Sellers moved, Hubbard seconded to reopen the regular meeting at 9:25
a.m. Motion carried.
Earned Income Tax: Sellers discussed the
proposed earned income tax that was being considered to cover increasing
expenses due to development and the complexity of operations in the
township, and additionally to purchase open space and fund future projects
in the township. The Board discussed the implementation of this tax. The
Board decided an article should be included in the spring newsletter
outlining the utilization of the money collected from an earned income tax
for open space acquisition, trail linkages, the act 537 plan, emergency
services (fire and ambulance), possible part-time police protection in
addition to state police coverage, and increasing operating expenses.
Brutscher agreed to write this article. The Board agreed further
discussion of this tax would be necessary.
Chester County Prison Expansion Project:
Brutscher moved, Sellers seconded to approve the Chester County Conditions
of the Park Land and Open Space Declaration of Covenants, Conditions and
Restrictions with no further changes. Motion carried.
Brutscher said the deeds of conveyance for the parkland and the signed
conditions and covenants be completed as quickly as possible so the
parkland can be conveyed to the township in May.
Sellers noted that the northern most corner of Wawaset Road will have to
be subdivided from the township’s parcel.
Public Comment: No public comment.
Other Business: Brutscher said Bruce Yelton has made a submission
to add his property into the Agricultural Security District, and the
township will wait the 180 days and add the property by Resolution.
Brutscher said she had spoken with some of her neighbors about adding
their properties to the Agriculatural Security District.
Sellers announced that on Friday, March 26th the Board had met
with Bernard Baily, Gary Burcham, and John Fenn to discuss placement of
several dwellings on the Corrine Village property. Brutscher said the
developer had gone back to Burcham’s original plan that was submitted with
the conditions of stipulation.
Minutes of March 22, 2004: Brutscher moved, Hubbard seconded to
approve the minutes as submitted. Motion carried.
Codifying Ordinances: Brutscher said she and the township
secretary had met with a representive from General Code to discuss
codifying the ordinances for the township. The Board briefly discussed
this issue and unanimously agreed to hire General Code to codify the
township’s ordinances.
Brutscher moved, Hubbard seconded to hire General
Code to codify the township’s ordinances. Motion carried with all in
agreement.
Roads / Building Inspection: Harwood said the
curbside chipping in subdivisions was completed last week. Harwood said
the township building will be getting some improvements this week and the
landscaping will be installed this spring. Harwood said there are some
road repairs being done this week, and the dump truck is being advertised
for sale. Harwood reported on building permits that have been issued for
the last three months. Sellers inquired about the paving of township
roads this spring. Harwood said he had not yet determined what streets
will be paved in the township. Sellers said Denton Hollow Road will need
to be paved this year.
Treasurer’s Warrants: The warrants were approved and signed as
submitted. Brutscher asked the secretary to place the salary issue on the
next supervisor’s agenda.
Supervisor Georgia Brutscher exited the meeting at
10:05 a.m.
Pennwycke: Township Solicitor Unruh, Supervisors Sellers and
Hubbard discussed the proposed settlement agreement of the Pennwycke
subdivision with their legal counsel, Mr. Noonan; Engineer, P.J. Close;
and Tom Cappie.
