Board of Supervisors’ Meeting

8:45 a.m., Monday, May 10, 2004

    
Sellers opened the meeting at 8:45 a.m. with the pledge of allegiance.  Supervisors Brutscher and Hubbard were in attendance.  Also in attendance was Building Inspector and Code Enforcement Officer, William Harwood. 

Announcements: 
Sellers reported that John Theilacker is available on Thursday at 3:00 p.m. to discuss the C|ounty grant application. 

PA State Police/Avondale Barricks:  Lt. Dougherty from the PA State Police, Avondale Barricks, was in attendance to ask the Supervisors if they had any issues for him to address.  He went over accidents reports and incidents that had occurred in Pocopson Township over the last year and answered questions from the Board and residents attending the meeting.  Brutscher requested Lt. Dougherty to increase patrols on Route 52 and Route 842 during peak traffic times to calm traffic during rush hour.  Harwood asked what rights the township has as far as abandoned vehicles and ATV’s.  Lt. Dougherty said the township can notify the state police about abandoned vehicles.  ATV’s and dirt bikers have to be caught in order for the state police to prosecute violators.

Conditional Use Hearing:
Sellers moved, Hubbard seconded to close the regular meeting at 9:10 a.m. to hold a Conditional Use Hearing to review the application of Albert Gorman to add an apartment to an existing barn.  Motion carried.

The Board agreed that Mr. Gorman will have to supply the township with the draw down test to determine if there is adequate water supply for the additional water requirements that will be needed for the living quarters. 

Sellers moved, Hubbard seconded to continue the conditional use hearing until the information about the well could be supplied.  Motion carried.

Sellers moved, Hubbard seconded to close the Conditional Use hearing at 9:26 a.m. and reopen the regular meeting.  Motion carried.

Open Space Committee:  Hubbard said the Open Space Committee meets tomorrow night and there will be a discussion of ATV’s and dirt bikes being ridden in the park.  Brutscher said the spring newsletter should include a request for volunteers to create “Friends of the Park.”  This would hopefully solicit volunteers to help police the park.  Hubbard agreed to have the committee write an article for the newsletter.  Harwood said he had met with Mr. Hipkins about the trail that is being installed on his property.  Hipkins suggested that the trail be relocated to a different place on the property.  Harwood said they have the trail cut and it is ready for crushed stone. 

Hubbard requested the Board of Supervisors to use Pocopson Park on August 7th  for his daughter to get married in the park.  Hubbard said this is a non-alcoholic event.  Sellers  said a bond for $200 to cover clean up costs will be required and will be fully refunded if the grounds are returned to their previous condition and an application for park use will need to be submitted.  Hubbard noted that the Open Space Committee will need to design a usage permit for the park which they will address at the next OSC meeting.  The Board approved Hubbard’s request to use the township park.

Winterwood – Final Plan Subdivision:  Jim Fritsch, Art Sagnor, and Scott Megill were present to request final plan approval.  Sagnor said John Fenn requested that a note informing the homeowner how to remove the lid on the seepage tank for cleaning and inspection should be added to the homeowner’s documents.  Sagnor said that lots 3& 4 will have a shared driveway agreement that will end where the driveway goes through the open space.  Sellers said that the conservation easement and the homeowner’s document should be separate agreements to give the township authority to enforce the restrictions on the open space.  Sagnor agreed to write the agreements as requested. There was a discussion about trails that are located in this subdivision.  Fritsch asked if the Board would grant final plan approval with conditions.

Brutscher moved, Hubbard seconded to grant final plan approval to the Winterwood Subdivision plan drawn by Regester Associates dated April 6, 2004 with the following three conditions:

1.  NPDES permit must be received from the Chester County Conservation District.
2.  Finalize all Homeowner’s Documents, Driveway Easements, and the Conservation
     Easement.
3.  Finalize, fund, and execute the escrow agreements for road improvements in the    
     Winterwood Subdivsion.

Motion carried with all in agreement.

Earned Income Taxes:  Sellers said he had a few preparatory comments about the earned income tax before they received public comment.  Sellers reviewed the township budget and explained how excess funds had been used in the past.  Kristin Hoover expressed her concerns about the tax.  Ray Gamble, Steve Myers, David DeAugustine along with several other residents were present to discuss their opposition to a proposed earned income tax.  The Board invited the residents to participant in discussions and provide their suggestions on how to fairly implement a tax that would produce income for the increasing expenses the township will be facing in the near future. 

Extensions: 
Brutscher moved, Hubbard seconded to grant an extension to the Corinne Village Subdivision/Baily Tract. August 31, 2004.  Motion carried.

Brutscher moved, Hubbard seconded to grant an extension to the Brandywine Hardware Expansion plans until July 30, 2004.  Motion carried 

Chester County Prison Expansion Plan/Proposed Construction Detour:  The Board reviewed the proposed detour for the County Prison Expansion Plans with Bill Harwood.  The Board agreed to have Andy Rau, Township Solicitor, send a letter to Ron Nagle advising that the Board doesn’t want truck traffic on township roads and that there are serious traffic problems with the intersection of Locust Grove Road and Route 52 and Corrine Road and Locust Grove Road.  The secretary said she would notify Andy Rau to sent the letter.

Roads / Building Inspection:  Harwood reported that the Courts at Longwood escrow had been seized $87,000, and asked the Board for permission to finish up the work at this subdivision.  The Board agreed that the work should be completed as soon as possible.

Brad Bowman, a resident located on Clarks Lane, has a drainage problem in his front yard, and Harwood requested permission to install a 12” pipe with a drop box to pipe the run-off water to the stream at the bottom of Bowman’s property.  The Board agreed to allow Harwood have the road crew do the necessary work.

Minutes of April 26, 2004:  Brutscher moved, Hubbard seconded to approve the minutes of April 26, 2004 as corrected.  Motion carried.
