Board of Supervisors’ Meeting
7:30 p.m., Monday, May 23, 2005
Sellers dispensed with the pledge and called
the meeting to order at 7:35 p.m. Supervisor Brutscher was present.
Supervisor Hubbard was absent. Also present was Bill Harwood, Building
Inspector and Road Master; and Steve Conary, Planning Commission
Co-Chairman.
Announcements: Brutscher announced that she had represented the
township on May 11 at a meeting with DEP to discuss the sewage plans for
the Toll Brothers Project and Chester County Prison Expansion Project.
Brutscher reported that Craig Kologie, Castle Valley Consultants
represented the township at this meeting. Brutscher also reported that
she had attended a dedication ceremony for the Brandywine Valley Scenic
Byway today at Longwood Gardens at 11:00 a.m. The byway goes from Route
52 in Delaware to West Chester.
Sellers reported that Castle Valley had sent a
contract for the board to execute between Castle Valley Consultants, Toll
Brothers, and the township for sewage planning. Ross Unruh, township
solicitor, said the liability limits are too low and he would call Castle
Valley and advise them to raise the limits.
Castle Valley / Toll Brothers Agreement:
Sellers said that Castle Valley had sent a contract for the board to
execute between Castle Valley Consultants, Toll Brothers, and the township
for design work. Ross Unruh, township solicitor, said the liability
limits are too low and he would call Castle Valley and advise them that
the liability limits must be higher.
Sellers moved, Brutscher seconded to approve the
contract for sewage facility planning design work between Toll Brothers,
Castle Valley, and Pocopson Township with the changes proposed by the
township’s solicitor, Ross Unruh.
Haines Mill Road / One Way: Chris Baily,
attorney for Susan Williamson, was present to discuss the traffic study
that is being conducted by Traffic Planning and Design on Haines Mill
Road. Harwood said he would contact TP&D tomorrow and ask them to conduct
the study with the one-way signage down. The Board discussed vacating the
road to eliminate making the road one-way. Baily said he would contact
Harwood tomorrow to find out when the study would be completed.
Olmsted – Escrow Releases – Phases 1, 2, & 3A:
Sellers moved, Brutscher seconded to approve escrow
release #14 for Phase 1 in the amount of $7,212.50 in connection with
improvements at the Olmsted Subdivision. This release includes an
inspection fee of $777.50 payable to Pocopson Township. Motion carried.
Sellers moved, Brutscher seconded to approve escrow
release #11 for Phase 2 in the amount of $5,706.00 in connection with
improvements at the Olmsted Subdivision. This release includes an
inspection fee of $516.00 payable to Pocopson Township. Motion carried.
Sellers moved, Brutscher seconded to approve escrow
release #9 for Phase 3A in the amount of $49,616.50 in connection with
improvements at the Olmsted Subdivision. This release includes an
inspection fee of $2,786.50 payable to Pocopson Township. Motion carried.
The Board discussed escrow account phase 3B, and
determined that this escrow account could be closed as long as PennDOT was
satisfied with the road improvements along Route 52 at the Olmsted
subdivision associated with this account.
Bryant Sketch Plan: Steve Conary was present
to review the Bryant sketch plan with the Board of Supervisors, and
discussed the proposed entrance onto Wawaset Road. Conary said the
applicant is going to submit a revised plan showing the entrance further
to the south of the site.
Roads / Building Inspection: Harwood reported
he was applying for a grant from DEP to purchase a small dump truck to
replace the 98’ Ford pick-up truck that has 100,000 miles on it. Harwood
said with the grant and the sale of the truck, it shouldn’t cost the
township more than a few thousand dollars to replace the Ford. The Board
agreed that Harwood should apply for the DEP grant to purchase the dump
truck.
Toll Brothers / Sheeder Property: Brutscher
reported that Toll Brothers representatives were not present for the May
11th DEP meeting to discuss the sewage plan for the Sheeder
site. DEP would like the Toll Brothers sewage plant to accept the
Pocopson Schools sewage since their existing system is failing. Castle
Valley is going to study the concept of the school tying into the Toll /
Sheeder sewage facility. Sellers said he would like the Toll Brothers
trail on the Pocopson School side of the Sheeder property to be moved onto
the school property because of the steep grades on the Sheeder property.
Lenape Forge Appraisal: Sellers discussed the
appraisal of the Lenape Forge land east of the forge and west of the
Brandywine River. Brutscher said she was not in favor of using this land
for sports fields. No decision was made. Sellers said a decision has to
be made by the end of June as to whether this property should be purchased
by the township.
Arbaugh Property / Mackey Subdivision: Conary
reported that the PC discussed at their May meeting clustering two houses
on the Arbaugh/Mackey subdivision. Conary said that the wording in the
ordinance is confusing. Conary reviewed some proposed minor wording
changes to the ordinance. Sellers said this should be brought up in the
meeting at 3:00 p.m. on Thursday afternoon with Robert Lonsdorf,
Brandywine Conservancy. Conary agreed with Sellers suggestion.
Minutes of May 9, 2005: Brutscher moved,
Sellers seconded to approve the minutes of May 9, 2005 as amended. Motion
carried.
Treasurer’s Warrants: The warrants were
approved and signed as submitted.
Adjournment: The meeting was adjourned at
9:00 p.m.
