Board of Supervisors’ Meeting
8:45 a.m., Monday, June 13, 2005
Sellers called the meeting to order at 8:49 a.m.
and opened with the pledge of allegiance. Supervisors Brutscher and
Hubbard were in attendance.
Announcements: There were no announcements.
Open Space Committee Report: Hubbard reported that the township
secretary sent a letter to Chris Beck thanking him for building the bench
for the township park located behind the township’s garage. Hubbard
reported a grant that was submitted by Sarah Mims, Historic Committee, for
assistance with renovating the schoolhouse has been turned down. Hubbard
reported that the OSC meets tomorrow night.
Amy Hughes/Home Based Daycare: Amy Hughes was
present to discuss her request to open a group home based daycare for
approximately 12 children at her home located at 139 N. Wawaset Road, West
Chester, Pennsylvania. Brutscher said that Mrs. Hughes would need a
letter from the neighboring property owners stating that they did not have
a problem with the proposed daycare facility. Sellers said that Mrs.
Hughes would need to get a certificate from the health department stating
that her existing septic system’s size and adequacy could support the
daycare business. Mrs. Hughes said there would be no sign for the daycare
and no additional off-street parking would be provided. No retail sales
would be conducted, and there would be no business vehicle or sale of
storage of chemicals or biologicals. Mrs. Hughes said that there was
parking for her partner in front of her garage, and the additional paved
area would be turn around for drop off of children. Sellers reviewed
township procedures for the major home occupancy and said this application
would require the applicant to go before the zoning hearing board and a
conditional use hearing. In addition, it would be necessary to get
letters from the neighboring properties stating that they understand the
application for a major home occupancy. Sellers said the applicant did
not meet the ‘direct access’ definition as required by the township’s
ordinance. Mrs. Hughes thanked the Board for their time and said she
would consider her next step.
Baily Farm/Corine Village: Frone Crawford was
present along with Jim Brandolini and Sue Adhern, Evans Mill. Crawford
requested the Board to pass a resolution for the sewage facilities
planning modules so that the modules could be forwarded to DEP for their
review. An easement on the Baily property was discussed. Crawford said
that a simple subdivision plan will be necessary to go to settlement with
Bernard Baily on this property. The Board agreed to pass the resolution
for the sewage modules at the next Board meeting if Castle Valley
Consultants gives the modules their approval. Brandolini said they will
be presenting their latest revisions of Corrine Village to the PC at the
July meeting. Brutscher again requested Brandolini to provide samples of
building materials promised over a year ago.
Winterwood - Escrow Release No.09:
Brutscher moved, Sellers seconded to approve escrow release No. 9 in
connection with improvements at the Winterwood subdivision in the amount
of $17,790.00. This release includes an inspection fee of $3,190.00 that
is payable to Pocopson Township. Motion carried.
Road Vacation: Brutscher said the road
vacation documents are satisfactory, and the letters should be sent out to
the residents that are affected by vacating these two roads.
Lenape Forge Property: Sellers said that the
oil problem on the Lenape Forge property has been remediated to the best
of his knowledge. Sellers said the soil in the drainage ditch should also
be tested for contaminates. Sellers said he would contact the company
that did the original testing of this site and have them test the drainage
ditch.
Sellers moved, Hubbard seconded to have the drainage
ditch tested for contaminates before moving forward with the township
purchasing this property to add to their park system. Motion carried.
Brutscher was opposed.
Chester County Prison – Carve Out: The Board
reviewed the minor subdivision plan for the County property. Sellers said
the existing driveway access must be relocated to the best site distance
location on lot 2A which moves the driveway access to the south on this
property. Sellers said the County should bare the expense of doing the
necessary work to relocate the driveway. Sellers said the trail will be
located on this property paralleling Wawaset Road from the existing lot 1
across the front of lot 2A to connect to the main parcel to the south.
Sellers pointed out that there should be enough room to cross over to the
trail on the east side of Wawaset Road from the JDC. Sellers said all
items in John Fenn’s review dated April 27, 2005 should be addressed.
Sellers moved, Brutscher seconded to approve the
Chester County Prison / Carve Out plan, dated December 29, 2004, drawn by
Civil Engineering and Design Group with the conditions discussed above.
Motion carried with all in agreement.
Toll Brothers/Sheeder Property: Sellers said
that Toll Brothers should review their latest submission for the Sheeder
tract with the Planning Commission at their meeting later this week.
Minutes of May 23, 2005: Sellers moved,
Hubbard seconded to approve the minutes as submitted. Motion carried.
Treasurer’s Warrants: The warrants were
approved and signed as submitted. The secretary reviewed some
clarification issues from General Code regarding the codification of the
township’s ordinances.
Other Business: Brutscher reported that
she had volunteered to be the representative for Pocopson Township to the
Brandywine Valley Scenic Byway for the commission that is being
created to regulate the byway.
Hubbard acknowledged that he had received several
calls reporting that Mr. Hipkins had been burning, and the fire was
causing excessive smoke.
