Board of Supervisors' Meeting Minutes

8:45 a.m., July 12, 2004

   Sellers opened the meeting at 8:50 a.m. with the pledge of allegiance.  Supervisors Brutscher and Hubbard were in attendance along with Roads and Building & Zoning Officer, William Harwood.

Announcements:
Brutscher had no report from the KARPC because they do not meet in July and August.

Hubbard reported that the Open Space committee meets tomorrow night.

Scaleby Farm Extension:  Hubbard moved, Brutscher seconded to grant an extension to continue the plan review of Scaleby Farm Subdivision until September 30, 2004.  Motion carried.

Windy Hill - Deed of Dedication:  Harwood reported that the trail needs to be installed and the retension basin mowed. 

Brutscher moved, Sellers seconded to accept Resolution #07 of 2004 that designates Windy Hill Lane and additional right-of-way for Locust Grove Road and Corinne Road as well as a six -foot wide walkway easement as described in the deed of dedication.  Motion carried.

Brandywine Conservancy:  Robert Londsdorf presented a proposal to the Board to create a map and a list of resources and areas identifying as accurately as possible high priority woodlands and natural areas.  Londsdorf said there would be grant money from the county available to fund this project.  Londsdorf said the township’s actual cost to implement the project would not exceed $1,000, and the County would require 75%/25% matching grant money.

Brutscher moved, Hubbard seconded to approve the project outlined in the Brandywine Conservancy letter from Robert Lonsdorf, Senior Planner, dated July 9, 2004 to designate Township Natural Areas Identification with the cost of implementation of this project not to exceed $1,000.  Motion carried.

Bruce Yelton / Minor Subdivision:  Yelton asked if the confusion over the township engineer being told not to meet with him had been resolved.  Sellers said there was a misunderstanding of a discussion between himself and John Fenn.  Yelton proceeded to request subdivsion and zoning waivers that would be necessary for his minor subdivision plan, Deblyn V.  The Board and Yelton discussed the plan.  Sellers said the Board could waive zoning ordinances.  Sellers recommended to Yelton that he should have Jim Fritsch, Regester Associates, run the density calculations for this property.

Sellers moved, Hubbard seconded to grant the following two waivers to the minor subdivision plan titled Bruce Yelton Trust, Deblyn V, dated April 12, 2004:

1) Waiver on water supply section 601.F; 502.3 excluding section 502.3.A.3 (recharge facilities);
2) Waiver on 503.3.A excluding 2.E.

Motion carried.

Yelton clarified that the Board would like him to be more specific on his request for a waiver on section 504 of the SDLD.  Sellers said yes.  Sellers requested Yelton have a meeting with John Fenn to clear up outstanding issues related to these waivers.

Historic Schoolhouse:  Sellers said he had spoken with Representative Barrar, and Barrar had informed him that there was money in the budget to purchase the historic schoolhouse on Locust Grove Road.  Sellers said $122,000 was the negotiated price along with a trail easement on the property to connect to the township park.

Sellers moved, Hubbard seconded to purchase the schoolhouse for $122,000 and secure a trail easement to connect to the park, with the owner providing the township with the title search on this property.  Motion carried.  The secretary will look into whether the Open Space Budget will need to be amended.

Roads / Building Inspection:  Harwood said he had advertised the 1989 International Dump Truck in the Daily Local News and had received three bids which he presented to the Board for their review.

Brutscher moved, Sellers seconded to accept three bids for the 1989 International Dump Truck and awarded the highest bid to Road-Con, Inc., 917 Old Fern Hill Road, West Chester, PA for $9,200.00.  Motion carried.

Courts at Longwood - Harwood reported that Courts at Longwood is almost complete.  The survey (legal descriptions) needs to be completed.  The maintenance bond for the road will be funded and an attractive entrance sign will be constructed shortly.  The walking trail beside the basin located near the Shur property needs to be completed. 
Harwood said Courts should be ready for dedication soon. 

Brutscher asked about the trails in Olmsted, and Harwood said he had informed Berman that he would receive no building permits until the trails were repaired.

Brutscher said the Nuisance Ordinance should be on the agenda for discussion during the next Board meeting along with comments from the Planning Commission. 

Minutes of June 28, 2004:  Sellers moved, Hubbard seconded to approve the minutes of June 28, 2004 as submitted.  Motion carried.

Treasurer’s Reports:  The warrants were approved and signed as submitted.
