| Board of Supervisors' Meeting Minutes
7:30 p.m., July 26, 2004
Sellers opened the meeting at 7:45 p.m. with the
pledge of allegiance. Supervisors Brutscher and Hubbard were present
along with Roads and Building & Zoning Officer, William Harwood.
Announcements:
The secretary reported that Tom Bierl, OSC, has loaded the GIS software on
the new computer that was recently purchased by the township, and the
township office would be contacting Comcast tomorrow about connecting a
high-speed internet link to the new computer.
Sellers announced an East Bradford township supervisor had called him to
request the township to oppose the WCRPC transportation study
recommendation to relocate Route 52. It was agreed that our state
representative would convey that objection to East Bradford township.
Robert Lonsdorf/Brandywine Conservancy: Lonsdorf reviewed the
natural resources and open space protection plan and presented a document
to the Board outlining the scope of work for this project. Lonsdorf said
he had met with the OSC to review the proposal. He stated that the
Conservancy would be submitting the application to the County by the end
of the week. Lonsdorf said the township’s matching contribution if the
grant were awarded would be $7,500.
Brutscher moved, Sellers seconded to approve the proposal from the
Brandywine Conservancy for the grant application dated July 2004 which
outlines the scope of work and costs associated with the application to
the County requiring a $7,500 matching contribution from the township.
Motion carried.
Open Space Committee: Hubbard reported the Brandywine Conservancy
presented the Natural Resources & Open Space Protection Plan at their last
meeting and the OSC was in support of the grant application. Hubbard said
the OSC was also working on permit applications for park usage.
Township Auditor: The Board agreed to take Pat Schocie out to
lunch sometime in September to thank her for her many years of service as
township auditor.
Chester County Prison/ Intersection Improvements: Sellers reported
to the Board on the status of intersection improvements at Route 52,
Lenape-Unionville Road, and Wawaset Road connected to the prison expansion
project and said that PennDOT had not approved the submitted design for
these improvements. Sellers suggested that the township consider
requesting Brandolini and Berlin (developers in the immediate area) along
with the township to contribute some money toward design work of a
round-about for this intersection and present it to PennDOT.
Planning Commission Report: Steve Conary reported that the PC
committee had discussed the Yelton Minor Subdivision plan and reviewed the
nuisance ordinance at their meeting in July.
Bruce Yelton/Minor Subdivision: Yelton was
present to request the Board to clarify their position on his request to
waive Section 504 of the SDLD ordinances. Yelton said this section of the
ordinance causes him undue financial hardship. Conary, PC Member, stated
that the Planning Commission’s formal position on Yelton’s subdivision was
that there was no formal application before the township. After reviewing
section 504 of the ordinance, Sellers said the Board agreed that the
proposed project would be considered a minor subdivision and should
include Section 504.4, Maps 1 and 3 as part of the formal submission.
Yelton asked for clarification on Section 307.A.2 of the SDLD ordinance
regarding bonus tracts. Sellers said that bonus density could not be
brought from one tract to a two acre lot. Sellers said this issue could
be revisited at another time. There was a general discussion about bonus
density and marketability. Brutscher informed Yelton that his plan needs
to go back to the township PC for their review and comment before moving
forward any further.
Resolution #08 of 2004: Brutscher moved, Hubbard seconded to
approve Resolution #08 of 2004 which adopts the KARPC update to the
transportation study. Motion carried.
Mark Pevar: Harwood reviewed the request of Mark Pevar to waive
his requirement to plant 8 trees on Lot #7, Cannon Hill Drive. The Board
briefly discussed Pevar’s request.
Brutscher moved, Hubbard seconded to deny Mark Pevar’s request to waive
the installation of 8 trees on #7 Cannon Hill Drive and further that these
trees should be installed within 30 days of receipt of this letter.
Motion carried.
Osborne Place: Harwood reported that the
basin in Osborne Place has some further work that needs to be completed
and an as-built submitted of the changes to the basin so he recommended
the township not accept the deed of dedication at this time.
The Board agreed with Harwood’s recommendation.
Other Business:
Yelton asked if the prison agreement had been finalized. Brutscher
said an easement issue is still holding up the execution of this
agreement.
Sellers reported that the township solicitor is working on the final
agreement for the purchase of the historic schoolhouse on Corrine
Road. Sellers said he was not happy with the length of time it was taking
for the solicitor to complete this project.
Ricki Stumpo asked if Mr. Hipkins had been
cited for any of the five Sundays the Stumpos had reported excessive noise
from this property. Harwood said he had taken pictures of the equipment
that Hipkins is using to mow grass and the township solicitor said this
equipment is permitted to use for mowing. Stumpo said the trail has been
moved and the trail through the Hipkin’s property has three large holes in
it. Harwood said he would go down tomorrow and take pictures of all
Hipkin’s equipment for the solicitor to review. The Board discussed and
agreed the trail on this property should be installed as soon as possible.
Brutscher moved, Sellers seconded to approve 31st
Annual Marshalton Triathlon road race, October 3, 2004 closing Bragg Hill
Road with the following two conditions: 1) Certificate of Insurance naming
the township as an additional insured, 2) Completed Township road closing
permit. Motion carried. Hubbard recused himself.
Roads/Building Inspection:
Harwood reported Brandyridge residents have complained about noises and
smells from Brandywine Picnic Park. The Board said there was nothing the
township could do about this since the park is not in the township.
Harwood reported that PennDOT is going to pave Wawaset Road from Route 52
to Route 842 in the next two weeks. PennDOT is replacing all road signs
on Route 52.
Harwood said the township is going to pave Bragg Hill Road from Route 842
to Benzel’s property, part of Indian Hannah Road, the end of Bragg Hill
Road.
Brutscher suggested that when subdivisions are
finalized, they should be given a copy of the township sign ordinance.
Brutscher asked Harwood if a letter had been sent to the Board of Realtors
about signage in the township. Harwood said that the letter had been
sent.
Nuisance Ordinance: Brutscher said she had a sample of an
ordinance from New Garden Township that she would like to circulate to the
Planning Commission for their review. The Board agreed that the sample
ordinance the township has circulated is going to be abandoned and the New
Garden ordinance would be reviewed by the township PC.
Minutes of July 12, 2004: Brutscher moved,
Sellers seconded to approve the minutes of July 12, 2004 as amended.
Motion carried.
Treasurer’s Warrants: The warrants were
approved and signed as submitted.
Adjournment: The meeting was adjourned at
