Board of Supervisors’ Meeting

Monday, August 25, 2003

Brutscher opened the meeting at 7:30 p.m. with the pledge of allegiance.  Supervisor Hubbard was present along with Bill Harwood.  Absent was Supervisor Sellers.

Announcements:  Brutscher announced that she is attending a meeting of the Bayard Taylor Library Consortium on September 18, 2003 to review the budget latest revision of the Bayard Taylor Library.  Brutscher said that by September’s end the township should designate a library the township is going to support.  KARPC will start up in September and Brutscher said she will be attending.

Open Space Committee:  Hubbard reported the committee discussed linking the trail system in the township and the easements that would be necessary to accomplish this.

Lenape Springs Farm:  James Tupitza, attorney, was present to discuss the problem with the recorded plan and how best to resolve the problem so Red Hawk Trail could be dedicated to the township.  Brutscher and Hubbard agreed they would discuss this situation with Ross Unruh, and if he recommended the township accept Red Hawk Trail even though there is a minor discrepancy with the recorded plan, the township will accept the roadway for dedication, and Mr. Balbirnie will make payment to Pocopson Township in the amount of $1,000 for the plowing of Red Hawk Trail during the winter of 2003/2004.

Brandywine Hardware:  Brutscher moved, Hubbard seconded to extend Brandywine Hardware plan review until October 29, 2003.  Motion carried.

Olmsted:  Escrow Releases

  • Brutscher moved. Hubbard seconded to release Phase 1, Release No. 11 for $8,597.00 and Phase 3-A, Release No. 4 for $15,731.82 in connection with improvements at the Olmsted Subdivision.  There were no inspection fees associated with these two releases.  Motion carried.
  • Brutscher moved, Hubbard seconded to release Phase 3-A, Release No. 3 for $296,409.56 and Phase 3-B, Release No. 1 for $40,687.14 in connection with improvements at the Olmsted Subdivision.  There was a $4,426.50 inspection fee associated with release Phase 3-A, No. 3, payable to Pocopson Township.   Motion carried.

Public Comment:  The status of the prison project was discussed. 

Minutes of August 11, 2003:  Brutscher moved, Hubbard seconded to table the minutes of August 11, 2003 until the next Board meeting on September 8th

Hipkins Property:  Joe and Ricki Stumpo were present to discuss Mr. Hipkins dumping on his property Sunday, August 24.  Stumpo requested the Board to do something about the constant noise pollution from this property.  The Board discussed this problem with the zoning officer, Harwood.  The Board requested the secretary to contact John Hall in the morning to see how the Hipkins vs. Pocopson agreement could be enforced.  Brutscher and Hubbard reviewed a copy of a noise ordinance from Tredyffrin Township given to them by Mr. Harwood.  Hubbard said he would like to review this ordinance before it is sent to the township solicitor for their comment. 

Stumpo said she recently had to call the Health Department about a neighbor who had stopped having their rubbish picked up, and she was informed that if the township had a rubbish ordinance the Health Department could enforce it.  Brutscher asked Stumpo to call the Health Department and request a copy of a sample ordinance.

Treasurer’s Warrants:  The warrants were approved and signed as submitted.

Adjournment:  Brutscher adjourned the meeting at 8:42 p.m.
