Board of Supervisors
Regular Meeting
8:45 a.m., Monday, September 10, 2007
Sellers called the meeting to order at 8:50 a.m.
and opened with the pledge of allegiance. Supervisors Brutscher and
Hubbard were in attendance. Also in attendance were Bill Harwood, Road
Master; and Steve Conary, PC member.
Founders Day Update: Harwood and Hubbard reported the tot lot has
been completed. The pavilion is two thirds complete. The roof and floor
will be done this week. The cost of the concrete floor for the pavilion
was discussed, and there was concern whether there was enough money in the
budget to cover the costs. No decision was made.
Chester County Landscapes 21st Century Fund:
Round XVI Trail Development Grant Addenda: The County has agreed to grant
a six month extension to the term of the contract for the trails and
bikeway grant. The new contract expires on June 2, 2008. The Board
executed the contract, and it will be sent back to the Chester County Open
Space Preservation Department for final signatures.
Baily Farm/Corinne Village: In response to a letter dated August
8, 2007 from Fronefield Crawford, Jr. requesting the First Amendment to
the Stipulation and Order of the Baily Farm community dated October 14,
2003, the Board made a motion as follows:
Motion: Sellers moved, Brutscher seconded to accept and execute
the first amendment to the Baily Farm conditional use Declaration of
Restrictive Convenants. Motion carried.
Scaleby Farms:
Brutscher moved, Hubbard seconded to approve escrow release #2 in the
amount of $143,876.00 in connection with improvements at the Scaleby Farm
subdivision. An inspection fee of $6,619.50 has been added to the release
and is payable to the township. Motion carried.
Sellers moved, Brutscher seconded to approve escrow release #03 for
$58,995.00 in connection with improvements at the Scaleby Farm
subdivision. This escrow release has no inspection fees associated with
it. Motion carried.
Treasurer’s Warrants: The warrants were approved and signed as
submitted.
Roads: No report on roads. The road crew has
been working on the tot lot and pavilion in the township park in
preparation for Founders Day.
Public Comment: No public comment.
Minutes of August 27th: Brutscher moved, Hubbard
seconded to approve the minutes of August 27th as amended.
Motion carried.
Fall CCATO County Convention: Brutscher and
Sellers will attend the Fall County Convention at the Mendenhall Inn on
November 8, 2007.
Pocopson Park: The Board discussed use of the tennis courts by Mr.
Boubacar Toure for his professional tennis lessons. The board noted that
Mr. Toure is using the tennis courts for his personal business
approximately 29 hours per week. The tennis courts are primarily for the
use of Pocopson Township residents. The Board agreed a certified letter
will be sent to Mr. Toure informing him of the Board’s action that he may
no longer use the township’s tennis courts to give tennis lessons.
Brutscher suggested the PR&T Committee review usage of park facilities and
whether there should be some type of charge for certain types of
activities. The secretary said she would call several other
municipalities to ask them for their schedule of fees for park
facilities.
Ross Unruh, township solicitor, entered the meeting at 10:35 a.m.
Brenda White Farm/BHO Investors:
Present were Tom Pancoast, his attorney, Kristein Camp, Bunny Meister, and
several of the project’s investors.
Pancoast and Ms. Camp discussed the proposed conditions with the BOS and
Solicitor Unruh. After the discussion, the Board adjourned to an
executive session to deliberate.
Motion: Sellers moved, Brutscher seconded to close the regular
meeting at 10:45 a.m. for an executive session to deliberate the
conditions associated with the hearing for BHO Investors, L.P. - Brenda
White Farm, conditional use application. Motion carried. .
Motion: Brutscher moved, Hubbard seconded to
reopen the regular meeting at 10:50 a.m. Motion carried.
Brenda White Farm – Extension:
Motion: Brutscher moved, Hubbard seconded to grant an extension to
the plan review of the Brenda White Farm until November 10, 2007. Motion
carried.
The Board agreed a special meeting will be held on Friday, September 14th
at 8:00 a.m. to review the conditions as amended during today’s meeting
with the applicant.
Roads: Harwood requested the Board to accept
the salt bid submitted by the Municipal Cooperative of Southern Chester
County that was advertised in the “Daily Local News” on August 10 and 24.
Motion: Brutscher moved, Hubbard seconded to
accept the bid from the Municipal Cooperative of Southern Chester County
of $55.79 a ton for deicing salt from Oceanport Industries. Motion
carried.
Harwood said during the meeting he had called a cement contractor and
received an estimate of $1,200 for the floor in the pavilion. The Board
agreed to authorize $2,000 to pour a concrete floor for the park’s
pavilion and asked Harwood to install a sealer over the concrete once it
has cured. Harwood agreed to this request.
Cousins Property: Brutscher moved, Hubbard
seconded to authorize execution of the Brandywine Conservancy’s proposal
for preparing and holding a conservation easement on the Cousins’
approximately 19- acre property on Corinne Road in Pocopson Township (tax
parcel numbers 63-3-80.1 and 63-3-81.1). Motion carried.
The Board discussed financing the acquisition with Delaware Valley
Regional Finance Authority and asked the secretary to investigate what
types of loans are available to municipalities for open space
preservation.
Adjourment: The meeting was adjourned at 11:15 a.m.
