| Board of Supervisors' Meeting
Minutes 7:30 p.m., Monday,
September 27, 2004
Sellers opened the meeting at 7:33 p.m. with the
pledge of allegiance. Supervisors Brutscher and Hubbard were in
attendance. Absent was Bill Harwood, Director of Public Works and
Building Inspector.
Announcements:
Sellers announced that Bam Margera’s attorney had withdrawn Margera’s
appeal of the zoning violation issued to Margera on June 16, 2004.
Sellers addressed questions from several residents attending the meeting.
The secretary reported that Bob Woodward had
completed his technical review of the Greater West Chester Regional Area
Circulation Needs Impact Study and passed it along to Susie Breiseth for
her review.
Open Space Committee: Hubbard reported that a
letter had been sent to the Board from the OSC dated September 21st,
2004 requesting the township to purchase shrubbery to screen a trail that
borders the back of a property located in the Courts at Longwood.
Brutscher commented that the trails are on the approved plan for Courts at
Longwood, and the resident should have been aware of this before
purchasing the property. Sellers and Brutscher agreed that it is not the
township’s responsibility to screen residents from the visual impact of
any trails located near their property. Several trail connections were
discussed.
Bruce Yelton / Minor Subdivision: Yelton requested the Board to
grant an extension to his minor subdivsion plan until December 31, 2004 to
allow the him time to go before the Zoning Hearing Board.
Brutscher moved, Hubbard seconded to continue the review of the minor
subdivision application to seek variances from the Zoning Hearing Board
until December 31, 2004.
Steve Conary, PC Member, pointed out to the Board that Yelton’s minor
subdivision application had been formally turned down by the Planning
Commission on June 21, 2004 for being incomplete and asked how the Board
could grant an extension on this plan. Sellers said to table the
extension until later in the meeting to allow the Board time to review the
files.
William Waddington/Minor Subdivision: Brutscher moved, Sellers
seconded to continue the review of the minor subdivision of William
Waddington until November 30, 2004. Motion carried.
Other Business: Brutscher said she had attended the KARPC
meeting. Brutscher said she had a resolution that proposes Pocopson
Township provide a fair-share formula .25 mils to provide fire and
ambulance support services to the residents of Pocopson Township. The
Board discussed the proposed resolution and agreed to pass it as follows:
Brutscher moved, Hubbard seconded to approve
Resolution #13 of 2004 which states that Pocopson Township supports
the formula developed by the KARPC and will provide support to our local,
primary emergency services providers at a property tax rate equivalent to
0.20 mils for operating costs and 0.05 mils for capital support.
Motion carried.
Other Business: The secretary reported that Bill Harwood was going
to inspect Lot #7, Cannon Hill Drive to see if the required 8
trees had been planted. Brutscher pointed out that the trees were
supposed to be installed by September 30, 2004.
Public Comment: Several residents continued to discuss the Bam
Margera zoning violation with the Board. Nancy Ercolini pointed out that
there had been filming today on his property, and she had called Bill
Harwood to report it.
Susie Breiseth asked about the buffer of trees
that are supposed to be installed along the edge of the parking lot on the
soccer field side of Pocopson Park. Hubbard said he had thought
Bill Harwood had addressed this issue. Brutscher said the Board would
revisit this issue and possibly have several more white pine trees
installed in this area.
Yelton asked if the legal agreement had been
concluded with the Chester County Prison Project. Brutscher
said the amendment had been signed, but there was still a section of the
agreement that was being completed. Brutscher said the barn on the
property is slated to have a new roof installed this fall.
Peggy and Christopher Conaway were present to discuss their letter to the
Board dated September 22, 2004 regarding the Brandywine Picnic Park
fireworks display that was set off on September 17, 2004. Mrs.
Conary said the fireworks were so loud that they rattled windows, and she
felt that they were out of control. Mrs. Conaway said she would like the
Board of Supervisors to ban fireworks in the township. Hubbard pointed
out that the powder charge can be controlled, and he would speak to Ross
Capps, Brandywine Picnic Park about the direction these fireworks were
released and lowering the powder charge. Hubbard said he would have
Conaways added to the mailing list for notification.
Bruce Yelton/Minor Subdivision continued: The Board continued the
discussion with Steve Conary and Bill Waddington, Planning Commission
Members, on whether this application can be extended or should be turned
down tonight.
The Board adjourned to an executive session at 9:10 p.m. Sellers
reconvened the meeting at 9:20 p.m. After a discussion with Mr. Yelton,
the following resolution was adopted.
Brutscher moved, Sellers seconded to accept Resolution #14 of 2004 for the
minor subdivision plan submitted by Bruce Yelton based upon a plan
prepared by Regester Associates (consisting of two sheets and dated April
12, 2004); the application was denied for the following reasons:
1) Pursuant to the letter of the Pocopson Township Planning Commission
dated June 21, 2004, the Plan submission fails to include all of the
information and material required by Sections 504 and 505 of the Township
Subdivision and Land Development Ordinance, and necessary for any
approval;
2) Pursuant to the June 16, 2004 summary memo from John Fenn, P.E., P.L.S.
of Vandemark and Lynch, Inc., the Plan submission fails to include data
and information required by the Township Zoning and Subdivision and Land
Development Ordinances. Further, the applicant has failed to the address
all of the Fenn comments; and
3) Pursuant to the August 20, 2004 and September 8, 2004 memos from John
Fenn, P.E., P.L.S. of Vandemark and Lynch, Inc., the information indicated
on the Plan submission does not show that the proposed lots can be created
in accordance with the applicable provisions of the RA Residential and
Agricultural District.
Motion carried.
Minutes of September 13, 2004: Sellers moved, Brutscher seconded
to approve the minutes of September 13, 2004 as amended. Motion carried.
Treasurer’s Warrants: The warrants were
approved and signed as submitted.
Executive Session: Sellers moved, Brutscher
seconded to adjourn to an executive session at 9:50 p.m. to discuss legal
matters and housekeeping issues. Motion carried.
Adjournment: The meeting was adjourned at
10:20 p.m.
