Board of Supervisors' Meeting Minutes

7:30 p.m., Monday, October 25, 2004

  Sellers opened the meeting at 7:35 p.m. with the pledge of allegiance.  Supervisor Hubbard was in attendance.  Also in attendance was Bill Harwood, Director of Public Works and Building Inspector.

Announcements:  The secretary reported that she is attending a class on Wednesday, October 27, 2004 in Lancaster to become a notary.

Open Space Committee:  Hubbard reported the OSC is interviewing 3 groups representing sports camps at Pocopson Park.  The committee is investigating complaints about ATV’s and dirt bikes using the township trails illegally.  Hubbard reported the trails are being posted with signs and a letter is going to be sent to the parents of the violators.  Mr. Delaney, Osborne Place HOA, reported that the trails behind his property and that border Haines Mill Road have washed out due to recent storms.  Bill Harwood said the township would contact Megill Homes about repairing the trails on this property.

Supervisor Georgia Brutscher entered the meeting at 7:50 p.m. 

Winterwood Subdivision – Escrow Release #1: 
Brutscher moved,  Hubbard seconded to approve escrow release #1 in the amount of $20,548.00 in connection with improvements at the Winterwood project.  An inspection fee of $1,580.00 has been added to the release request and is payable directly to Pocopson Township.  Motion carried. 

Olmsted, (Alan Johnson) Phase #4 – Escrow Release: 
Brutscher moved, Hubbard seconded to approve escrow release #4 in the amount of $7,210.00 in connection with improvements at the Olmsted, Phase 4, project.  An inspection fee of $431.00 has been added to the release request and is payable directly to Pocopson Township.  Motion carried.

Scaleby Subdivsion:  Brutscher moved, Hubbard seconded to grant an extension to continue the review of the Scaleby Farm Subdivision until March 30, 2005.  Motion carried.  

Nuisance Ordinance / Advertisement:  Brutscher moved, Hubbard seconded to advertise the nuisance ordinance in the “Daily Local News” for adoption at the November 8, 2004 morning Board meeting. 

Nextel Communication Tower:  The Board discussed the request from Nextel to install a communications tower on the township property located at 740 Denton Hollow Road.  Harwood suggested requesting a tower that is constructed to look like an evergreen tree.  Brutscher asked the secretary to have Nextel make a presentation at the next Board meeting in November.

Brutscher – Minor Subdivsion:  Sellers and Hubbard discussed the request dated November 18, 2004 from George Brutscher requesting an extension to the five year protection period of the plan under the Municipalities Planning Code.  Brutscher is requesting an extension to the five year period of his subdivision plan.  Sellers said the new zoning ordinance should be amended so that people who place conservation easements on their property when subdividing are not penalized.

Public Comment:  Mr. Delaney, Osborne Place HOA, asked about responsibility of the maintenance of storm basins in Osborne Place.  Sellers said the township would contact Megill about mowing and cleaning out the basin located on a homeowner’s property since Megill is still in the 18 month maintenance bond period.  Sellers said after the maintenance bond expires, the HOA is responsible for maintenance on the retention basin. 

In response to a question from Mr. Delaney about the damaged bridge on Red Lion Road, Harwood said he would contact Steve Barrar’s office in the morning to request them to have PennDOT inspect and possibly repair the Red Lion Road bridge.

Gary Summers stated that he had heard that Jim Brandolini, Corinne Village Subdivision, was going to attend the next Board meeting on November 8th to discuss Corinne Village stormwater issues and landscaping.  Summers urged the Board not to compromise the conditions of the settlement agreement on the Corrine Village as it relates to storm water and landscaping issues.

Roads / Building & Zoning: 
Brutscher reported the trails in Olmsted are in terrible condition. Harwood said the township engineer and Olmsted engineer should meet to discuss the on-going problem with the trails washing out during heavy storms.  Hubbard said he had talked to John Fenn, township engineer, today, and they are going to revisit the issue of the trails and drainage basin problems on the Olmsted property. 
Harwood reported the township road crew had just completed some patching and paving on Marlborough Road, Indian Hanna Road, Bragg Hill Road, and Locust Grove Road.  Brutscher said the storm drain at the Eschelmen property has been flooding.  Harwood said this property has been flooding at that location for years.  Harwood reported the Fence Authority was in the process of constructing two warehouses on their property.

Minutes of October 12, 2004:  Brutscher moved, Hubbard seconded to accept the minutes of October 12, 2004 as amended.  Motion carried.

Treasurer’s Warrants:  The warrants were approved and signed as submitted.

Michael Arbaugh / Minor Subdivision: The secretary asked if the Arbaugh minor subdivision would be required to contribute to the open space fund.  The Board agreed that a fee in lieu of $2,500 per lot could be postponed until the time of building permit issuance on the two new lots being created, but the existing lot would have to pay the $2,500 at the time of subdivision approval.  The Board agreed that Mr. Arbaugh would be responsible for the installation of the trail along his property line on Marlborough Road.

Adjournment:  The meeting was adjourned at 8:55 p.m.
