Board of Supervisors' Meeting Minutes

7:30 p.m., Monday, November 22, 2004

     Sellers opened the meeting at 7:35 p.m. with the pledge of allegiance.  Supervisors Brutscher and Hubbard were in attendance.  Also in attendance was Bill Harwood, Director of Public Works and Building Inspector.
 
Announcements:
 
Hubbard and Sellers attended a meeting last week at DEP on Thursday, November 4th to discuss constructing a bridge across Pocopson Creek in the Overlook Subdivision located on Lenape Road to connect the township’s trail system.

Brutscher reported that she had attended a meeting a KARPC, and the committee is asking townships to include a $5,000 line item in the 2005 budget for funding a project in 2005.

Open Space Committee:  Hubbard reported that UK Elite Soccer would like to continue their soccer program next summer, and the OSC had interviewed US Sports Institute about conducting several other sports camps during the summer.  Hubbard also said the committee is going to discuss a “Kid’s Day” in the park at their next meeting.

Brandywine Hardware Expansion:  Robert Adams, Attorney; Chester Diem, Regester Associates, Inc.; Richard Moore, Applicant; were present to discuss the hardware store expansion plan.  Adams discussed the applicant’s intent to purchase a portion of ISG Railway property to accommodate the expansion of the hardware store and said there is an agreement of sale pending.  Adams addressed the fact that the PC had requested a crosswalk be constructed across Pocopson Road.  Adams said the crosswalk is going to be constructed by the railway to specifications.  Diem gave the Board a copy of his response letter dated November 22, 2004 to Fenn’s review of November 15, 2004.  Diem reviewed the 16 items on Fenn’s review and how these items have been addressed.  Diem discussed the requested waivers.  The Board agreed to approve the expansion as follows:

Brutscher moved, Hubbard seconded to grant the following four waivers from the Pocopson Township Subdivision and Land Development Ordinance as follows:  Section 502, Section 503.2M, Section 503.3, Section 504.  Motion carried with all agreed.

Brutscher moved, Hubbard seconded to approve the Brandywine Hardware Store expansion plans drawn by Regester Associates, Inc., last revised 11/22/2004 with the conditions set forth below:
1) Township will notify John Fenn that no further response is necessary related to stormwater comments 4 and 14 on his review.
2) Proof of purchase of additional land or 99 year lease from ISG Railway.
3) Concurrence that John Fenn’s comments dated November 15, 2004 satisfactorily addressed.
4) No building permit issued until all improvements (trees, parking spaces, railroad crosswalk, signage for handicapped parking) are completed.
5) Brandywine Power Equipment - Conditional Use Hearing stipulations are still required to be satisfied.

Other Business:  Brutscher said that Bruce Yelton had previously applied to add two of his parcels (7.33 and 4.626 acres) into the township’s agricultural district.  Brutscher asked the secretary to prepare a resolution to add this property to the agricultural district, and would like this item on the next board meeting agenda. 

Sellers said the township attorney had sent a notice that the County Prison Project had executed the construction agreement and funded the construction account.  The County has informed the township that they would fund standard road improvement costs not the roundabout.  Sellers said the problem is there has been no dollar amount determined for the intersection improvements.  Brutscher asked the secretary to contact Andy Rau and inform him that the Board of Supervisors’ would like a meeting with the County officials to discuss the status of the intersection and also inform Rau that Castle Valley Consultants has not been kept informed of the status of the sewage facilities planning modules. 

Public Comment: 
Mr. Armstrong, a resident on Parkersville Road, was present to complain about stormwater run off from Parkersville Road destroying his property and asked the Board for some type of help with this problem.  Harwood said he had reviewed the problem with the resident and budgeted next year to install a larger pipe under the road. 

Mr. Soloway, a resident on Denton Hollow Road, was present to ask about the status of the Nextel cell tower that was being considered.  Sellers informed Mr. Soloway that Nextel Communications had made a presentation to the township to construct a communications tower on township property, but, that the township had not entered into negotiations with Nextel and no decisions had been made by the Board. Sellers said that in the future, the township would keep the residents on Denton Hollow Road notified when this issue was on the agenda.  Roads:  No report.   

East Bradford Township Official Map:  Brutscher said the township has no zoning conflicts with the proposed maps.  The secretary will send a letter to East Bradford Township saying the Board is in agreement with the East Bradford Township proposed map.

Budget 2005:  Harwood proposed budgeting $2,000 from the Open Space Fund to purchase deer feeders with insecticide for deer tick control, and notify the township HOA’s and request them to purchase feeders for their open space.  The secretary suggested adding this to the next newsletter.  Sellers said there should be money budgeted for the Historic Committee to hire an architect for the schoolhouse restoration project.

Treasurer’s Warrants:  The warrants were approved and signed and submitted.

Minutes of November 8, 2004:  Brutscher moved, Hubbard seconded to approve the minutes of November 8, 2004 as amended.  Motion carried. 
 
Adjournment:   The meeting was adjourned at 9:30 p.m.
