Pocopson Township Planning Commission Meeting

Planning Commission (PC) Members Present: Gary Summers, Suzy Breiseth, Sean Rafferty, Meg Johnson, Rob Miller, Steve Simonson.  PC Member Absent:  Rob Costello

1. Call to Order: Summers called the meeting to order at 7:30 p.m.

2. Public Comment: none.

3. Ordinances:

      a) Pre-draft windmill/wind energy – Summers noted that Haaf is not able to continue work on the pre-draft. Secretary will obtain additional information for the draft during a Township Secretary meeting on Solar/Wind/Alternative Energy System Ordinances to be held on May 25, 2010.

      b) Pre-draft fences/walls – tabled to June 2010 meeting (Breiseth).

      c) Pre-draft noxious weeds – tabled to May 2010 meeting (Simone).

      d) Administrative updated/housekeeping – review of the County of Chester Planning Commission comments regarding the amendment of Section 190-5 to include the language “abutter” and the addition of a new subsection 190-12 regarding the responsibility of the applicant to notify abutters when an application is before the Planning Commission for consideration. Secretary is directed to resubmit text as previously approved by the Board of Supervisors and Planning Commission.

 

PC reviewed Pocopson Township Resolution 2010-14 Winter Parking for the purpose of revising Chapter 221, Section 3 regarding the requirement of the storage facility vendor to post a bond. An extended discussion ensued regarding the amount of liability coverage and the amendment of Section 3 to require a certificate of insurance (“certificate”) instead of a bond. PC agreed that the certificate of insurance is evidence of the existence of insurance coverage as it includes the effective date of the policy, type of insurance, and dollar amounts. While the certificate is not a substitute for a formal review of the insurance policy, the certificate summarizes the type of coverage and amounts of coverage. Naming the Township as an additional insured on a liability policy provides adequate protection as long as the liability limits are appropriate for the storage of towed vehicles. Secretary is directed to submit amended language to the Board of Supervisors for approval.

 

Simonson noted that under Section 250-96.G an owner of a communication tower higher than 35 feet is required to routinely submit to the Township proof of an annual inspection and tower maintenance program. Secretary is directed to verify that such documents are currently on file in the Township office. 

 

4. Pocopson Comprehensive Plan – Updates for the October 2001 Plan: PC members were provided copies of the October 2001 Plan. Summers indicated that the Board of Supervisors should contact the PC regarding the path forward for the update.

 

5. Correspondence and announcements: none.

6. Other business: none.

7. Approval of Meeting Minutes:  Motion: Summers moved to accept the Minutes of March 17, 2010, as submitted; Rafferty seconded; motion unanimously approved. 

8. Adjournment: Summers moved to adjourn at 9:00 p.m., Rafferty seconded; motion unanimously approved. The next regular scheduled Planning Commission Meeting is Wednesday, May 19, 2010.
